Contractor and to determine in general if such work is proceeding in <br />accordance with the Contract Documents. <br />e. Review and approve (or take other appropriate action with respect to) <br />Shop Drawings (as that term is defined in the Contract Documents), <br />samples, and other data which the Contractor is required to submit, but <br />only for conformance with the design concept of the Project and <br />compliance with the information given in the Contract Documents. Such <br />reviews and approvals or other action shall not extend to means, methods, <br />techniques, sequences or procedures of construction or to safety <br />precautions and programs incident thereto. <br />£ Issue all instructions of the OWNER to the Contractor; issue necessary <br />interpretations and clarifications of the Contract Documents and in <br />connection therewith, prepare change orders as required; have authority, <br />as the OWNER'S representative, to require special inspection or testing of <br />the work. <br />g. Based on TKDA'S periodic on -site observations as an experienced and <br />qualified design professional, determine payments to the Contractor in <br />such amounts; such recommendations of payment will constitute a <br />representation to the OWNER, based on such observations and review, <br />that the work has progressed to the point indicated, that, to the best of <br />TKDA'S knowledge, information and belief, the quality of such work is in <br />accordance with the Contract Documents. <br />h. Conduct an inspection to determine if the Project is substantially complete <br />and a final inspection to determine if the work appears to have been <br />completed in accordance with the Contract Documents and if the <br />Contractor has fulfilled all of his obligations thereunder, so that TKDA <br />may recommend, in writing, final payment to the Contractor and may give <br />written notice to the OWNER and the Contractor that the work is <br />acceptable (subject to any conditions therein expressed). <br />i. TKDA shall not have control or charge of and shall not be responsible for <br />construction means, methods, techniques, sequences or procedures, or for <br />safety precautions and programs in connection with the Work, for acts or <br />omissions of the Contractor, Subcontractors or any other persons <br />performing any of the Work, or for the failure of any of them to carry out <br />the Work in accordance with the Contract Documents. <br />j. Prepare Assessment Role and attend Assessment Hearing. <br />
