3. Construction Phase - Resident Services <br />In addition to the above General Services, TKDA shall provide the services of a <br />Resident Project Representative (and assistants as agreed) at the site to assist <br />TKDA and to provide more continuous observation of the Contractor(s) work. <br />The Resident Project Representative (and any assistants) will be TKDA'S agent <br />or employee and under TKDA'S supervision. Resident Project Representative's <br />dealings in matters pertaining to the on -site work shall in general, be only with <br />TKDA and the Contractor, and dealings with subcontractors shall only be through <br />or with full knowledge of the Contractor. Written communication with the <br />OWNER will be only through or as directed by TKDA. Through the observations <br />of the work in progress and field checks of materials and equipment by the <br />Resident Project Representative, TKDA shall endeavor to provide further <br />protection for the OWNER against defects and deficiencies in the work of the <br />Contractor; but the furnishing of such resident Project representation will not <br />make TKDA responsible for construction means, methods, techniques, sequences <br />or procedures or for safety precautions or programs, or for the Contractor's failure <br />to perform his work in accordance with the Contract Documents. <br />This Authorization provides for up to 72 hours for Construction Observation. <br />III. ADDITIONAL SERVICES <br />If authorized in writing by the OWNER, TKDA shall Runish or obtain from others Additional <br />Services of the types listed below which are not considered as normal or customary services. <br />Additional Services shall be compensated for on an Hourly Rate basis as defined in the General <br />Agreement, a part hereof, and such compensation shall be over and above any maximums or <br />lump sum amounts set forth in this Authorization. <br />A. Registered land or right-of-way surveys, right-of-way mapping; plats; legal descriptions; <br />land appraisals, negotiations and/or related services. <br />B. Investigations of existing conditions or facilities or to make measured Drawings thereof, <br />or to verify the accuracy of Drawings or other information furnished by the OWNER. <br />C. Soil borings and laboratory tests for design purposes; field and/or laboratory tests taken <br />during construction to determine compliance with the Contract Documents. <br />D_ Providing analyses of the OWNER'S needs and programming the requirements of the <br />Project; investigations involving detailed consideration of operations, maintenance and <br />overhead expenses; providing Value Engineering during the course of design; the <br />preparation of cash flow and economic evaluations, rate schedules and appraisals; <br />assistance in obtaining financing for the Project; detailed quantity surveys of material, <br />equipment and labor. <br />-5- <br />
