The Planning Commission recommended the City initiate an amendment to the zoning ordinance in line <br />with that standard. The 10-acre standard now applies to all "domestic animals, livestock or kennels". If it <br />is the intent to amend only to horses, the City must be able to distinguish a difference between the use in <br />keeping horses and these other types of animals. <br />The Council found that horses are typically kept for riding, used as a recreational animal. The staff was <br />asked to check with West Lakeland or other communities with 5-acre minimum if they have encountered <br />any problems, such as, setback issues, feedlot concern. A Conditional Use Permit or a variance could do <br />approval. <br />M/S/P Dunn/Armstrong —to direct the Planning Commission and staff to initiate an amendment to reduce <br />lot size for keeping of horses. (Motion passed 5-0). <br />B. Planning Commission Referral: Ag Zoning Classification amendments <br />Planner Dillerud reported the Planning Commission initiated consideration of amendment of the AG <br />Zoning District standards and provided a draft of the proposed amendments. In his memo to the Council, <br />Chairman Armstrong asks for Council advice and direction on the proposed amendments. <br />The Council asked for the following: delete brewery/winery as one of the permitted uses because of <br />concerns with bringing in other products that could be sold at the same time and becoming a retail <br />operation; have offices restricted to permitted uses, and delete small landscape operations. <br />M/S/P DeLapp/Dunn — to proceed ahead with the Ag Zoning Classification Amendments, as amended, at <br />the May 16 Council meeting. (Motion passed 5-0.) <br />C. Sign Variance Appeal: Richard Kosman, Leslie's Floor Decor <br />Planner Dillerud reported the Planning Commission unanimously adopted a Resolution denying the Sign <br />Ordinance Variance application of Mr. Kosman to construct a replacement sign at Leslies's Floor Decor of <br />72 square feet area, at a height of 14 feet, and set back from State Highway 5 a distance of 9 feet. The Sign <br />Ordinance standards are 30 square feet maximum area, 6 feet maximum, eight and 15 minimum setback. <br />Rich Kosman explained the sign surface coverage is 56 sq.ft., smaller than what he currently has now, and <br />will go with the one sign. He wants to raise sign for a better line of vision. The sign is lighted only during <br />business how's. <br />Mayor Hunt opened up public hearing at 8:05 p.m <br />Arlo Frost, Chair of the Lake Elmo Village Commission, submitted a memo in opposition to granting a <br />variance. The large signs near the road obstruct the view along State Hwy 5. The plants underneath will <br />make it a solid sign. There is evidence that larger signs tend to promote faster traffic. Concerns about <br />traffic were expressed at the Village Commission meeting. The sign's size, location, and appearance are <br />inconsistent with the proposed design guidelines of the Village Commission. <br />Arlo Frost requested the Village Commission be involved with decisions on applications in the Old Village <br />area. <br />Administrator Kueffner indicated the Village Commission does not have the authority to look at <br />applications now, and the code needs to be changed to include this requirement if applications are going to <br />be reviewed by this commission. <br />Council member Dunn is supportive of the variance because signage is important to a business. This is a <br />preexisting business located on a state highway, has a positive influence, and does not generate traffic. The <br />City should work with the business owner.
