He reported a little <br />league group was working to improve Pebble Park; he is sending our RFP's for Lion's Playground. <br />Councilor Armstrong asked if the tennis court surface at Tablyn Park was scheduled, but not <br />completed for re -surfacing, to which Supervisor Bouthilet replied, "No." <br />7.0 May Building Permit Fees Update: Jim McNamara <br />Building Official McNamara reviewed the May 1, - May 31, 2000 Building Permit fees. He <br />suggested information regarding new home starts in Lake Elmo may be of interest to readers of the <br />City newsletter, and said he would coordinate this with the editor. <br />City Engineer's Report <br />8.A 25`s Street & Lisbon Avenue Vacation Resolution (Postpone to July 18, 2000) <br />(Enter kwrcgaz'ung this issue re vk&June 19, 2000 f rma A=nq Scott McDonald) <br />8.B Wastewater System Design Basis for Lots 2, 3, & 4, Block 2, DeMontreville <br />Highlands, Third Addition. <br />Engineer Prew stated that when the original plat for this subdivision was filed, groundwater testing <br />was completed at the site, and the lots did not meet the code requirements. He explained the <br />developer requested installing mound systems, but the request was denied, and subsequently, State <br />Code changed, and alternate septic system designs are now permitted. <br />The City Council took no action on this issue because Lake Elmo Code currently allows wetland <br />treatment systems. <br />The City Attorney will prepare language that would appear on deeds of conveyance advising <br />purchasers that wetland treatments systems are allowed in the City and on this site. <br />8.0 Adoption of Performance Based Septic System Ordinance <br />M/S/P Armstrong/Siedow — to adopt Ordinance 9755, whereby Minnesota Rules, part <br />7080.0179 is incorporated by reference into the Lake Elmo Municipal Code. <br />(Motion Passed 5.0). <br />9. Planning, Land Use & Zoning <br />9.A Approve Sign Variance Appeal — Leslie's Floor Decor <br />Councilmember DeLapp said he disagrees with the findings of fact presented by the applicant. He <br />pointed out that the lot is smaller than other downtown businesses — why the need for a larger sign; <br />applicant chose to change the sign; 10 variances to the applicant; does not know what the hardship <br />is; people have different sensitivities, and the sign ordinance is meant for sight sensitive people & <br />Lake Elmo people are more sensitive than people from other cities. <br />Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 5 <br />
