Council member Armstrong said she voted in opposition to the sign previously and said her <br />concerns were similar to those of Council member DeLapp's. She said she has a problem granting <br />variances when there is no real hardship. <br />Mayor Hunt said he felt this situation has special circumstances and agrees that the variance should <br />be granted. <br />M/S/P Dunn/Siedow - to adopt Resolution 2000.021 an order issued by the Board of <br />Adjustment and Appeals approving the requested variances on Appeal by Richard Kosman, <br />Leslie's Floor Decor, based on findings. <br />(Motion Passed 3-2). <br />M/S/P Dunn/DeLapp - to amend the agenda to move Planning Issue 9.1) to follow 9.A <br />(Motion Passed 5-0). <br />9.13 Open Space Concept Plan, D.T. Development/Tjosvold/Zehrer <br />Planner Dillerud said at its May 2, 2000 meeting, the City Council tabled consideration for this OP <br />Concept Plan for 17 home sites on a site of slightly less than 40 acres to allow the applicants an <br />opportunity to reconsider several design features of the Concept. He noted the <br />alterations/amendments to the previously submitted plan, as found in the observations of the staff <br />report. He said, with the revisions to the Concept now proposed, staff finds it to be significantly <br />more responsive to the intent and purposes of the OP Ordinance than the earlier version, <br />sufficiently so as to recommend approval, with the following conditions: L) a finding by the City <br />Council that introduced landscaping is responsive to the screening requirements required to reduce <br />site property line setbacks from 200 feet to 100 feet, 2.) Modification of the Concept Plan to add site <br />screening of equal scale and density to those lots on the East side of the plat where house pads are <br />less than 200 feet from the East property line, 3.) City Council direction regarding the applicant's <br />proposal for reduced side yard setbacks - it is the recommendation that such a reduction only be <br />approved in cases where side loaded garages are actually constructed. <br />Tim Freeman (representing the applicant) <br />Folz, Freeman & Dupay <br />Mr. Freeman explained that the applicant wants to preserves the woods in the North side of the site <br />and will introduce landscaping in the South side, he encouraged the side load garage plan; said the <br />plan met the code requirements for an OP Development. He mentioned that the Fields of St. Croix <br />Village Greens were created to offer a meeting place for neighbors, and the village greens in this <br />proposal were the same dimensions, he said he can alter the placement of the driveway for the flag <br />lot. <br />Neil Severson <br />Resident <br />Mr. Swanson said he would like to see a buffer where the current house is located and expressed his <br />concern that 16`h Street might not be paved. <br />Gary Axberg <br />Resident - Parkview Estates <br />Mr. Axberg said he had concerns about integrating a farm with a residential area; said he sees the <br />current farm with animals creating problems and may devalue property; asked why preserve open <br />space, yet allow a barn; said the flag lot impacts 4/5 lots in Parkview Estates; supportive of the <br />Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 6 <br />
