M/S/P Dunn/Siedow — to advise the City staff that it is the City's official position that it <br />is not interested in participating in the forum suggested by the Metropolitan Council staff. <br />(Motion passed 5-0.) <br />10. CITY ATTORNEY'S REPORT: <br />The city attorney submitted his review on the Lake Elmo Banquet Hall in letter dated <br />April 16, 2002. He indicated that he talked to Jon Place's attorney, who said his client <br />would be willing to sit down and work with the City to resolve the problems. A meeting <br />will be set up with Jon Place, City Planner and the City Administrator. <br />The city attorney asked if the City wanted to do anything about the condition of the alley <br />since the dirt was placed there following Mr. Place's blacktopping of his parking lot. The <br />city administrator had previously directed staff to place class 5 in the right-of-way, but <br />the crew would first have to dig out the muck. Additionally, there is a concern that <br />placement of the class 5 would increase an already serious drainage problem and with the <br />swale between the carpet store and adjacent home. <br />M/S/P Dunn/DeLapp — to direct the City Engineer to work with Xcel Energy and come <br />back with a plan to have the poles moved closer to the blacktopped area, and create a <br />more gradual entrance to the alley, and receive plan approval from Council. The staff <br />will proceed as needed and keep track of all expenses incurred. Neighbors to the alley <br />will be notified of the plan. (Motion passed 5-0.) <br />11. CITY ADMINISTRATOR'S REPORT: <br />A. Unfinished Business <br />Administrator Kueffner provided an update on Unfinished Business. <br />#5 Preliminary Plans for City Hall Addition <br />Planner Dillerud reported on the Facilities Committee will have a report in 60 days and <br />will be on the agenda in June. <br />#8 Storm Water Utility <br />M/S/P Dunn/Armstrong — direct the City Engineer to review the 1993 Storm Water <br />Utility draft and update the study to current dollars. (Motion passed 5-0). <br />414 Goetschel Property on 50th Street <br />The city engineer reported that the culvert was replaced just as it was prior to the <br />reconstruction of 50a' Street. <br />#18 Contract with Northwest Planning for Zoning Code Update <br />Administrator Kueffner provided a memo and recommendation on this proposed contract. <br />M/S/P DeLapp/Dunn — to ask the Planning Commission to reconsider the contract with <br />Northwest Planning for zoning code update based on concerns raised about this company. <br />(Motion passed 5-0.) <br />LAKE ELMO CITY COUNCIL MINUTES APRIL 16, 2002 10 <br />
