City Attorney Filla prepared a supplement to the Eagle Point 2nd Addition Development <br />Agreement that addresses the additional developer obligation and costs for construction <br />of utilities in that portion of Eagle Point Boulevard between the two cul-de-sacs. The <br />Parks Dedication fee -in -lieu in the amount of $32,599.20 will be payable with the <br />Building Permit. Attorney Filla also prepared an amendment to the Development <br />Agreement for Eagle Point Business Park 2nd Addition, which extends the completion <br />dates for the Eagle Point Boulevard. Street and Utility Improvements to December 31, <br />2002. <br />M/S/P DeLapp/Armstrong — to adopt Resolution No. 2002-028 approving the <br />Preliminary Plat of Eagle Point Business Park 3`d Addition. (Motion passed 5-0). <br />M/S/P DeLapp/Siedow — to adopt Resolution No. 2002-029 approving the Final Plat and <br />Development Agreement for Eagle Point Business Park 3`d Addition. (Motion passed 5- <br />0). <br />M/S/P DeLapp/Siedow — to approve version 2 of Amendment No. 3, as presented at the <br />April 16 Council meeting, to the Eagle Point Business Park 2°d Addition Development <br />Agreement to extend the completion date for public improvement to December 31, 2002. <br />(Motion passed 5-0). <br />United Properties Special Assessment Reapportionment Request <br />The finance director reported United Properties has requested the special assessments <br />levied on Outlot B of the Eagle Point Boulevard Second be reapportioned due to the plat <br />development for Bremer Financial. There are two assessments: Utility Assessment with <br />a principal balance of $79,459.92 and 2001 Street Assessment with a principal balance of <br />$83,047.76. <br />NUS/P DeLapp/Dunn — to approve the reapportionment of special assessments, as <br />presented, on Eagle Point Boulevard, Outlot B. (Motion passed 5-0). <br />E. Comprehensive Plan Update: Obiectine Land Owners <br />The city planner reported that since the completion of the local hearing process on the <br />new Comp Plan, several large land owners (including North Suburban and Dale <br />Properties) have directed letters to the Metropolitan Council that object to the City's <br />decision not to propose extension of the MUSA and the regional sewer that would go <br />with that extension. The planner was advised that the Metropolitan Council staff was <br />considering a forum at which these objecting land owners would be permitted to make its <br />case for MUSA and sewer in Lake Elmo. He said he was asked if Lake Elmo wanted to <br />participate. <br />The Council indicated the objecting land owners had an opportunity to address their <br />concerns at the public hearings and other processes State Law prescribes for local <br />planning. <br />LAKE ELMO CITY COUNCIL MINUTES APRIL 16, 2002 <br />
