Zoning Ordinance Amendment — Accessory Structure Location <br />The city planner presented a recommendation from the Planning Commission to repeal <br />the entire paragraph of the Code that prohibits garages/accessory structures in front of <br />principal structures, but allows variation from that rule in certain zoning districts by <br />resolution of the City Council. From the Commission's discussion, Dillerud indicated it <br />was not their intent to repeal the prohibition itself, but rather to repeal the process <br />provided for overcoming the prohibition in certain zoning districts. The concern <br />expressed was that this provision is a part of the zoning ordinance. Other provisions of <br />the zoning ordinance can be deviated by the Council, as the Board of Appeals, only upon <br />Public Notice, adjacent property owner notice, Public Hearing and Planning Commission <br />recommendation. The majority of the Commission believed this should be the process <br />with the subject provision as well. <br />Attorney Filla advised the staff that if the City Council supported the Planning <br />Commission's recommendation, a public hearing would have to be called because the <br />direction was to look at taking out the clause "and written approval by adjacent property <br />owner to be submitted to the Zoning Administrator". <br />M/S/P Siedow/DeLapp — to adopt Ordinance No. 97-107, amending Section 300.13 <br />Subd.3I. requiring written approval by adjacent property owners. (Motion passed 5-0). <br />M/S/P Siedow/Dunn — to direct the Planning Commission to look into modifications of <br />the paragraph in Section 300.13 Subd. 3I, as presented in Rod Sessing's recommendation. <br />(Motion passed 5-0.) <br />C. Repeal of Highway Business Zoning District <br />The city planner reported that the 2000 City initiative to repeal the Highway Business <br />Zoning District stopped following the Planning Commission Hearing and <br />recommendation on October 11, 2002. Attorney Filla indicated the text could be <br />repealed, but the Planning Commission should hold a public hearing to establish the <br />existing uses of the four Highway Business sites as General Business uses, and re -label <br />the zoning map for these sites to General Business. Council member Armstrong <br />suggested the deletion of hang gliders, which would make them a non -conforming use. <br />D. Preliminary Plat, Final Plat & Development Agreement - Eagle Point BP 3rd <br />Addition <br />The city planner reported the Planning Commission recommended approval of the <br />Preliminary Plat of the Eagle Point Business Park 3`d Addition, which is the site of the <br />Bremer Financial project.
