Lake Elmo public meeting 4/9/02 <br />regarding the mining site used by Shafer Construction <br />Comments from: Mark and Theresa Schulz <br />4030 Isle Avenue North <br />Lake Elmo, MN 55042 <br />Preface: We understand Shafer Construction is operating at the mitring site legally and with a <br />valid conditional use permit. Although we do not like the fact that they are there mining, we will <br />not address that issue here. We appreciate the fact that they created a large dirt berm to help ward <br />off some of the offensive noise and dust corning from the field. But we have some remaining <br />concerns: <br />Concern #1: Illegal use of the mining site by people on dirt bikes, motorcycles, all -terrain <br />vehicles, and snowmobiles. <br />• The noise of these vehicles is obnoxious, especially in the warm months when we have <br />our windows open. <br />• Many of these people get to the mining site by riding directly over our front lawn or <br />backyard without our permission, often leaving tire marks and damaging the lawn. <br />• We have planted dozens of small spruce trees on the side of our property that borders the <br />mining site, only to find several of them have been run over and destroyed by the people <br />riding the motorized vehicles illegally in the mining site (and on our adjoining property). <br />• We have repeatedly talked to the people who are out there on their motorized vehicles <br />and asked them to stay off our lawn and not ride along our home. But they ignore our <br />requests. <br />• We have repeatedly called the Washington County Police to come out and inform these <br />people they are at the mining site illegally. The police do usually eventually come out, <br />but it is often more than an hour after the call was made, so the people on the motorized <br />vehicles are often already gone. <br />Proposed solutions to concern #1: <br />1) Post no trespassing signs with warnings of punishment. <br />2) Post regular notices in the Lake Elmo newsletter that this site is off limits and trespassers <br />will be fined. <br />3) Mail letters to inform residents that this field is off limits and violators will be fined. <br />4) Have the police respond promptly (when they can) and issue tickets/impose fines. <br />
