M/S/P Armstrong/Siedow - to rebid roof replacement for Fire Stations No. 1 and No. 2. <br />(Motion passed 4-1: Hunt: We only received one bid, but it's within the range and would <br />be good to get the work done) <br />M/S/P Armstrong/Siedow - to draft Resolution No. 2002-055 rejecting the bid for roof <br />replacement for Fire Stations No.1 and No. 2. (Motion passed 5-0.) <br />M/S/P DeLapp/Siedow - to direct the staff to get bids to repair the walls of building. <br />(Motion passed 5-0). <br />9. PLANNING, LAND USE & ZONING: <br />A. PJRealty/PJIGnney, Minimum Lot Size Variance <br />The City Planner reported the Planning Commission recommended approval of this <br />zoning variance to construct a new home on a lot of record of 30,403 square feet on <br />Stillwater Blvd. The minimum lot area for "grandfathered" lots is specified by the <br />Zoning Ordinance to be 1 acre (43,560 sq.ft.). A second Commission motion directed <br />staff to prepare Findings in support of the approval recommendation. <br />The City received a letter from Dorsey & Whitney LLP, representing John Duffert and <br />Marie Rau, who live immediately to the east of the property, stating reasons they feel <br />there is no legal basis or justification for granting this variance. <br />The Council noted there is a severe slope on this property and the creek has flooded the <br />property. There was not sufficient data designation of the flood plain. The City <br />Administrator explained the code states when contiguous lots are in one common <br />ownership, the lots have to be combined. <br />P. J. Kinney submitted information from Dale Elkin and other information for council <br />consideration. Mr. Kinney will be out of town on the July 2"d and asked for his item to <br />be on July 16tn <br />M/S/P DeLapp/Armstrong - to direct the staff to prepare resolution to deny the variance <br />to Patrick Kinney/P.J. Realty for a minimum lot size variance to allow construction of a <br />home on Lot 7, Beau Haven/Outlot G, Eagle Point Creek Estates based on the four <br />findings in staff report and other findings include at meeting be the denial for this request. <br />(Motion passed 5-0). <br />P. J. Kinney submitted information from Dale Elkin, Soil Scientist, and other information <br />for council consideration. Mr. Kinney will be out of town on the July 2"d and asked for <br />his item to be on July 161'.
