M/S/P DeLapp/Armstrong — to support warning siren funding and to purchase and install <br />sirens at areas #1 and #2 providing that the area be moved farther to the southeast to <br />minimize overlaps in coverage. (Motion passed 5-0). <br />Council member Dunn stated she would rather a siren not be located in the middle of <br />Sunfish Park, but this will be discussed at a later date. <br />The Council postponed setting aside $9,000 annually for the 2004 component program to <br />be discussed at the CIP budget process. The City Planner will see this agenda item comes <br />back to the Council. <br />E. Zoning Variance — PJKinney <br />The City Planner explained the Council table this application and directed Staff to <br />prepare a Resolution of Denial, incorporating the Findings of the April 3, 2002 Planning <br />Staff Report, and other findings based on Council discussion at the June 18, 2002 Council <br />meeting. Mr. Kinney requested that consideration of the Denial Resolution by the <br />Council be postponed to the meeting of July 16 since he would not be able to attend the <br />July 2"d meeting. <br />Mr. Kinney stated he has 23 years of real estate experience. He provided a blueprint and <br />a letter from Dale Eklin indicating a septic system could be placed on the lot. Per Mr. <br />Kinney, a two-story walkout could be built within the gully. When asked by Attorney <br />Filla if he had reviewed the City's regulations before be purchased the property, Mr. <br />Kinney responded he did not review the City's regulations. Mr. Kinney stated he did not <br />apply for a variance prior to purchasing this property and did not purchase the property <br />contingent upon granting of the variance by the City, only contingent upon perk test <br />approval. <br />M/S/P Dunn/Armstrong — to adopt Resolution No. 2002-068, A Resolution Denying <br />Patrick Kinney/P.J. Realty, Inc. Request for a Minimum Lot Size Zoning Variance as <br />modified (B. WHEREAS replace "drawing" with "dwelling'; ADD: M. WHEREAS, <br />Patrick Kinney has 23 years of real estate experience; did not review the City's <br />regulations prior to purchase; did not apply for a variance prior to purchase and did not <br />purchase the Kinney property contingent upon granting of a variance by the City. <br />(Motion passed 5-0). <br />F. Section 520 Site Plan — Gorman's Restaurant <br />The City Planner reported the Planning Commission recommended for approval this <br />application to remodel and add on to the existing Gorman's Restaurant. A complete <br />description of the work is found in the Planning Staff Report of June 5, 2002. The <br />approval recommendation was subject to the applicant providing plan set additions and <br />modifications regarding landscape islands, front setbacks landscaping; storm water <br />drainage calculations; and, septic system capacity data. The Planner reported that all of <br />this information had been supplied and reviewed/approved by the City Engineer as to <br />LAKE ELMO CITY COUNCIL MINUTES JULY 16, 2002 <br />
