is very close to $35,000. A portion of the approved trail alignment with the plat may <br />have value as a Public Trail. The extent of the trails that the Council deems of value as <br />Public will be constructed to a higher standard —an extra 2 inches of rock base. The cost <br />of this extra construction and any easement value determined by the City's appraiser <br />would be credited to the final Park Dedication Fee payable to the City. <br />It was the consensus of the Council that the developer's surveyor would prepare Public <br />easements to the City for the entire proposed trail except the portion in the village green. <br />Also, Public easements would be prepared to extend the trail northeasterly from the <br />northeast corner of the 43`d Street North right of way; and, southerly to the south line of <br />the plat. Additional Public trail should be constructed in the northeasterly extension, but <br />not in the southerly extension. The developer will be given credit to the 7% Park <br />Dedication Fee for the value of the Public easements, as determined by the City <br />appraiser; and, credit for the cost of 2 inches of additional based material (to a total of 6 <br />inches) under the Public trail sections, the value of which to be determined by the City <br />Engineer. <br />The Lake Elmo Parks Supt. will look at what should be done in the area of the Shiltgen <br />property and the possibility of erecting a fence. <br />M/S/P Armstrong/DeLapp - to adopt Resolution No. 2002-125, Approving the Final Plat <br />and Development Agreement for Sunfish Ponds on the following condition: 1. <br />Compliance with the requirements of the City Attorney and City Engineer. 2. Park <br />Dedication Fee to be 7% of he Appraiser's market Value less Trail Credit as determined <br />by City Staff and the Park Commission and 4. Defining the public trail and completion <br />date. (Motion passed 5-0). <br />C. Escrow Release - Tamarack Farm <br />The City Engineer certified that all required improvements within this project are <br />complete and recommends release of escrow and final acceptance by the City. The City <br />Planner reported that he and Mike Bouthilet reviewed the tree planting with the approved <br />Landscape Plan for the project and agree that, although the new trees are grouped more <br />than the original plan showed, the count appears to be in line with the developer's <br />responsibilities on approved landscape plan, when the several naturally wooded lots are <br />considered. <br />Staff recommends release of the remaining $8,750 Letter of Credit security for plat <br />improvements; and acceptance of the Public Improvements constructed within the plat. <br />M/S/P Dunn/Armstrong — to release Tamarack Farms Estates development security in the <br />amount of $8,750 (Letter of Credit #295) and to accept Public Improvements.
