ARTICLE II - ACCESS CONTROL ACQUISITION <br />The Village shall acquire the access control along both sides of the Village street <br />(Helmo Avenue) from the westerly right of way limits of Trunk Highway No. 94 ex- <br />tending 300 feet northwesterly from said right of way limits and submit to the <br />or other instrument <br />State a copy of a final certificate/as evidence that the Village has acquired the <br />necessary access control. It is understood and agreed that the Village will <br />acquire the said access control without cost or expense to the State. <br />ARTICLE III - PAYMENT BY THE STATE <br />The State shall pay to the Village, upon the completion of the Village access street <br />construction, the lump sum of $51,115.10 as payment in full as the State's share <br />of costs incurredby the Village in constructing the Village access street (Helmo <br />Avenue) from Minnehaha Lane to the westerly terminus of,the Trunk Highway No. 12- <br />No. 8282-06 (T.H. 94=392). Said Village street construction project will provide <br />access for Parcel 17, which is one of the State's right of way negotiation parcels <br />for the acquisition of right of way for said Trunk Highway No. 94. Said sum of <br />$51,115.10 represents the total estimated construction cost for the Statts proposed <br />access service road connection which was to provide access to said Parcel 17 if <br />the State was to construct said access service road connection plus an amount equal <br />to 8 percent of the estimated construction cost for said proposed access service <br />road connection. <br />The estimate of cost for the said proposed access service road connection which <br />is to be deleted from the construction work to be performed by the State under, <br />State Project No. 8282-06 (T.H. 94=392) and is attached hereto and marked <br />"Exhibit B" and made apart hereof. <br />-6- <br />
