R--73-23 <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ORDERING TESTING OF SEPTIC SYSTEMS AND ELIMINATION <br />OF POLLUTION. <br />WHEREAS, it appears to the Village Council of the Village <br />of Lake Elmo, that Lakes DeMontreville, Olson, and Jane (herein- <br />after referred to as the "Tri-Lakes") may be subject to pollution <br />as a result of defective individual sewage disposal systems or <br />waste water disposal systems; and <br />WHEREAS, the pollution of said Tri-Lakes would be a potential <br />health hazard to the residents of the Village and, in addition, <br />the pollution of said lakes would destroy an invaluable natural <br />resource: <br />NOW, THEREFORE, BE IT RESOLVED as follows: <br />1. The Village Engineer is hereby directed to proceed <br />forthwith with the inspection of each individual sewage disposal <br />or waste water disposal system located on lots having frontage <br />on any one of said lakes or on ponds or streams directly tributary <br />thereto, for the purpose of determining whether or not any such <br />system is, by reason of its inadequacy or lack of capacity, <br />contributing directly or indirectly to the pollution of any of <br />said lakes. <br />2. The Village Engineer shall make a written report of <br />his findings to the Village Council; said report shall contain <br />his recommendations as to the necessity and method of correcting <br />the defects and eliminating any source of pollution. <br />3. The Clerk shall forward a copy of said report and <br />recommendations to the Village Attorney who shall then proceed <br />to prepare notices to the individual property owners of the <br />corrective action necessary and the time within which they will <br />be allowed to take such action; said notice shall inform the <br />property owner that if corrective action is not taken and the <br />corrected system approved in writing by the Village Engineer within <br />the time allowed, legal action will be taken to permit the Village <br />to correct the defects and assess the cost against the property <br />involved. <br />Adopted by the Village Council this 19th day of June, 1973. <br />G <br />alvin Broo an, ayor <br />Attest: <br />Donald Mehsikomer, Clerk <br />
