R-73-34 <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ESTABLISHING DRIVEWAY LOCATION FOR GRAVES' PROPERTY <br />WHEREAS, Charles W. Graves and Marian N. Graves, husband <br />and wife, owners of Lots Five and Six, First Re -Arrangement <br />of Lot Three, Block Three, Lake Elmo Park, have heretofore <br />obtained Village approval to place a residential dwelling on <br />said property; and <br />WHEREAS, the Village Council has determined that in order <br />to prevent a road maintenance problem on 32nd Street (formerly <br />North Shore Drive), and in order to be consibtent with other <br />development in the area, the driveway for access to the Graves' <br />residence should be from 33rd Street Lane on the North instead <br />of 32nd Street; and <br />WHEREAS, the Village Council has also determined it would <br />not be economically desirable for the Village to extend said <br />33rd Street Lane South to the Graves' property; and <br />WHEREAS, the Village owns the Westerly 120.16 feet of Lot <br />Seven, First Re -Arrangement of Lot Three, Block Three, Lake Elmo <br />Park, which property the Village has acquired for park purposes: <br />NOW, THEREFORE, BE IT RESOLVED by the Village Council that <br />in order to accomplish the purposes of the Village Council and <br />require Graves to construct their access drive to the North of <br />the property owned by them, the Village Council does hereby grant <br />Charles W. Graves and Marian N. Graves an easement for access <br />purposes in and over the Westerly 15 feet of said Lot Seven, all <br />of which is hereby determined to be within the right-of-way of <br />any future extension of 33rd Street Lane to the South and at such <br />time as said street is extended on and over the land subject to <br />the easement granted hereby, said easement shall terminate. <br />IT IS FURTHER RESOLVED, that said easement shall be non- <br />exclusive in that it may be used by the public as a means of <br />ingress and egress to the adjacent park lands. <br />Adopted by the Village Council th' 16th day of October, 1973. <br />Calvin J. rookman, Mayor <br />Attest: <br />14 <br />Donald Melisil mer, Clerk <br />
