RESOLUTION R-74-26 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION APPROVING PROPOSED ALLOCATIONS OF COSTS <br />FOR THE BATTLE CREEK WATERSHED DRAINAGE AREA IMPROVEMENTS. <br />WHEREAS, on or about the 8th day of March, 1972, the City of Lake Elmo <br />entered into a joint and cooperative agreement for obtaining an overall plan <br />to control flooding and development of the Battle Creek Drainage Area with <br />the following governmental units, to -wit: <br />City of St. Paul <br />County of Ramsey <br />City of Maplewood <br />City of Oakdale <br />City of Landfall, and <br />City of Woodbury; and <br />WHEREAS, said joint power parties have received a study prepared by E. A. <br />Hickok and Associates regarding a plan to control flooding and flood damage <br />within the Battle Creek Drainage Area; and <br />WHEREAS, representatives of the said joint power parties have arrived at <br />a tentative proposed agreement as to the allocations of costs for preliminary <br />design studies and for implementation of a final plan of control subject to the <br />approval of the governing bodies of said governmental units; and <br />WHEREAS, it appears that unless said joint power parties are able to re- <br />solve the problems of water control within the Battle Creek Drainage Area and <br />agree to an allocation of costs for the implementation of said plans of control, <br />that a new watershed district will be created; and <br />WHEREAS, the City Council of the City of Lake Elmo is strongly and unanimous- <br />ly opposed to the creation of a watershed district by reason of the fact that such <br />a district is not in the interest of public health or public welfare of the City <br />of Lake Elmo, and that the water control problems of the Battle Creek Drainage <br />Area can best be resolved by means of a joint power agreement among the above - <br />named communities, <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake <br />Elmo as follows: <br />1. That the City of Lake Elmo hereby endorses and reaffirms the use and <br />concept of a joint powers agreement to accomplish the control of flooding and <br />flood damage within the Battle Creek Drainage Area. <br />2. That the City of Lake Elmo hereby agrees to pay 1.83% of the total <br />costs of the preliminary design studies and for the implementation of final plans <br />of control for the Battle Creek Watershed District; that it is the understanding <br />of the City of Lake Elmo that the balance of the costs of participation will <br />be allocated as follows: <br />
