Minutes of Lake Elmo City Council Meeting, October 18, 1977. pg. 3 City Office: Question raised as to what has been done relative to changes in the present city office for expansion. Before any changes can be considered a decision has to be reached as to how to handle location of maintenance office. Tour of Landfill building available to those interested on Saturday, October 22 at 10:30 a.m.. Matter will be set up for discussion at the Nov. 1, 1977 meeting. This to in- clude only two items, maintenance location, expansion of office. Administrative Ordinance: Motion by Councilman Shervheim 2nd by Council- man Morgan to adopt amendment to Ordinance 7413 to establish position and responsibilities of Administrative Assistant. Carried 5-0. CNW RR -------- Resolution -Clerk to send letter to CNW RR explaining that the drainage pipe put in by the City of Lake Elmo is of equal benefit to the city. Water Surface Regulation: Letter dated October 7, 1977 from J.N. Alexander, DNR, advised that Ordinance 7413 of the City of Lake Elmo regulating use of water surfaces was not satisfactory. It gave preferential treatment to raparian landowners which defeats state regulation that water surface belongs to everyone on an equal basis and everyone should be treated equally. Copy of letter to be referred to Water Surface Committee. Tax forfeit land: If city decides that it no longer has use for land it will revert back to the state. Decision yet to be made on the parcels involved. (Section 9 West of lot 15, Three Lakes Farm Addition). Moratorium: Motion by Mayor Armstrong 2nd by Councilman Morgan to pass the moratorium ordinance as amended at the meeting of October 11, 1977. Councilman Pott moved for an amendment to motion to change time frame from 6 months to a definite deadline of February 28, 1978. Amendment failed for lack of a second. Vote on original motion showed Mayor Armstrong, Councilman Morgan and Councilman Pott, for. Against -Councilman Shervheim and Councilwoman Lyons. Vote 3-2. Motion failed for lack of a 2/3 vote of all members of the council. Motion by Councilman Morgan 2nd by Mayor Armstrong to establish moratorium to be in effect until February 28, 1978. For -Councilman Morgan, Mayor Armstrong and Councilman Pott. q Against --Councilwoman Lyons and Councilman Shervheim. Motion failed on a 3-2 vote. Minutes: Motion by Councilman Shervheim 2nd by Councilwoman Lyons to approve minutes of Council meeting of October 4, 1977 as submitted. Carried 5-0. Claims: Motion by Councilman Morgan 2nd by Councilman Shervheim to approve payment of claims 77835 thru 77841. Carried 5-0.
