Minutes of Lake Elmo City Council Meeting, October 18, 1977. pg. 3 <br />City Office: Question raised as to what has been done relative to <br />changes in the present city office for expansion. Before <br />any changes can be considered a decision has to be reached <br />as to how to handle location of maintenance office. Tour <br />of Landfill building available to those interested on <br />Saturday, October 22 at 10:30 a.m.. Matter will be set up <br />for discussion at the Nov. 1, 1977 meeting. This to in- <br />clude only two items, maintenance location, expansion of <br />office. <br />Administrative Ordinance: Motion by Councilman Shervheim 2nd by Council- <br />man Morgan to adopt amendment to Ordinance 7413 to establish <br />position and responsibilities of Administrative Assistant. <br />Carried 5-0. <br />CNW RR -------- Resolution -Clerk to send letter to CNW RR explaining that <br />the drainage pipe put in by the City of Lake Elmo is of <br />equal benefit to the city. <br />Water Surface Regulation: Letter dated October 7, 1977 from J.N. Alexander, <br />DNR, advised that Ordinance 7413 of the City of Lake Elmo <br />regulating use of water surfaces was not satisfactory. <br />It gave preferential treatment to raparian landowners which <br />defeats state regulation that water surface belongs to <br />everyone on an equal basis and everyone should be treated <br />equally. Copy of letter to be referred to Water Surface <br />Committee. <br />Tax forfeit land: If city decides that it no longer has use for land <br />it will revert back to the state. Decision yet to be made <br />on the parcels involved. (Section 9 West of lot 15, Three <br />Lakes Farm Addition). <br />Moratorium: Motion by Mayor Armstrong 2nd by Councilman Morgan to pass <br />the moratorium ordinance as amended at the meeting of <br />October 11, 1977. <br />Councilman Pott moved for an amendment to motion to change <br />time frame from 6 months to a definite deadline of February <br />28, 1978. Amendment failed for lack of a second. <br />Vote on original motion showed Mayor Armstrong, Councilman <br />Morgan and Councilman Pott, for. Against -Councilman <br />Shervheim and Councilwoman Lyons. Vote 3-2. Motion failed <br />for lack of a 2/3 vote of all members of the council. <br />Motion by Councilman Morgan 2nd by Mayor Armstrong to <br />establish moratorium to be in effect until February 28, 1978. <br />For -Councilman Morgan, Mayor Armstrong and Councilman Pott. <br />q Against --Councilwoman Lyons and Councilman Shervheim. <br />Motion failed on a 3-2 vote. <br />Minutes: Motion by Councilman Shervheim 2nd by Councilwoman Lyons to <br />approve minutes of Council meeting of October 4, 1977 as <br />submitted. Carried 5-0. <br />Claims: Motion by Councilman Morgan 2nd by Councilman Shervheim to <br />approve payment of claims 77835 thru 77841. Carried 5-0. <br />
