R--78- 00 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING CONCEPT PLAN FOR BROCKMAN ADDITION, A <br />SUBDIVISION PROPOSED UNDER THE PROVISIONS OF CHAPTER 401 OF <br />THE CITY CODE REGULATING THE SUBDIVISION OF LAND. <br />WHEREAS, Calvin J. Brockman and Donald T. Raleigh, owners, and Anita <br />Brookman, contract seller, have filed a Concept Plan for the proposed sub- <br />division of BROOKMAN ADDITION for approval prior to incurring engineering <br />and other expenses for the design of streets, utilities, and storm water <br />controls and for the preparation of a plat; and <br />WHEREAS, the Concept Plan of the proposed subdivision, now on file <br />with the City Clerk, has been reviewed by the City staff and considered at <br />a public hearing by the City Planning Commission, all as required by Section <br />3 of the City subdivision ordinance; and <br />WHEREAS, the City Council has considered said Concept Plan, the recom- <br />mendation of the City Planning Commission, and the recommendations of the <br />City staff thereon; and <br />WHEREAS, the City Council has determined: <br />1. The Concept Plan for the proposed subdivision, now on file with the <br />City Clerk, is not in any way inconsistent with the public health, safety and <br />welfare. <br />2. The Concept Plan for the proposed subdivision is consistent with the <br />City's Comprehensive Plan, zoning ordinance, subdivision ordinance and other <br />applicable regulations: <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake <br />Elmo, that the Concept Plan for the BROOKMAN ADDITION subdivision, as filed <br />with the City Clerk, is hereby approved subject to the following conditions: <br />1. The approval of the Concept Plan for the BROOKMAN ADDITION, subdivision <br />is limited to those ;natters set forth in the Concept Plan and does not constitute <br />approval of the design standards for any of the streets or other public <br />improvements required by the City subdivision ordinance except that: <br />(a) The streets in said subdivision may be designed <br />with bituminous curbs and gutters to be used <br />until such time as sewer may be installed; <br />
