R-78-29 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING FINAL PLAT OF FOX <br />FIRE ESTATES <br />WHEREAS, the City Council of the City of Lake Elmo has <br />previously considered and approved the preliminary plat of FOX <br />FIRE ESTATES; and <br />WHEREAS, the applicant has now presented to the City a final <br />plat which conforms to the approved preliminary plat and meets <br />with the requirements of the City subdivision ordinance: <br />NOW, THEREFORE BE IT RESOLVED, that the City Council does <br />hereby approve and accept the final plat of FOX FIRE ESTATES, as <br />is on file with the City Clerk, subject to the following conditions: <br />1. The City Council shall not accept for maintenance that <br />part of Jamaca Avenue North lying South of a line drawn <br />East and West across said Jamaca Avenue North sixty (60) <br />feet South of, and parallel to, an extension of the <br />northerly line of lot three (3), block four (4), FOX <br />FIRE ESTATES. It is a condition of the approval of <br />the said final plat that all that portion of said Jamaca <br />Avenue North lying South of the turn -around located <br />between lots three (3) and four (4) of said block <br />four (4) shall be available for emergency use only, <br />as hereinafter provided. <br />2. All that part of Jamaca Avenue North located South of <br />the said turn -around shall be constructed to City <br />standards but no hard -surfacing shall be placed thereon <br />without specific written approval of the City Council. <br />The said portion of said Jamaca Avenue North shall be <br />maintained in accordance with the standards established <br />by the City Engineer, as a gravel road suitable for use <br />by emergency vehicles. That portion of said road <br />shall then be closed to general traffic by guard <br />rails and a gate constructed to specifications established <br />by the City Engineer. The gate shall be permanently closed <br />by lock or other security device which may be opened as <br />needed for emergency purposes. All construction of said <br />road including the guard rails, gate, security devices <br />shall be under the supervision of the City Engineer and <br />at the expense of developer. <br />
