3. All that part of Jerome Avenue North lying South of the <br />turn -around located between lot one (1), block five (5) <br />and lot seventeen (17), block four (4), shall not be <br />improved until such time as it may be extended to the <br />South and until such time it shall not be accepted for <br />maintenance by the City. <br />4. The developer shall file with the City a Certificate of <br />Survey prepared by a registered land surveyor describing <br />and certifying the location of the boundaries of 55th <br />Street North as that street is laid out and dedicated <br />between the plat of FOX FIRE ESTATES and the existing <br />public road known as DeMontreville Trail North. A Deed <br />or other instrument of conveyance approved by the City <br />Attorney dedicating the land so described as 55th Street <br />North shall be delivered to the City in proper form for <br />recording. <br />5. The applicant shall enter into a Development Agreement <br />as required by the City subdivision ordinance, providing <br />for the construction of all streets and related improve- <br />ments to City standards. The developers performance of <br />said Development Agreement shall be secured by security <br />bond, cash deposit, or letter of credit in a form approved <br />by the City Attorney, or such other security as may be <br />hereafter approved by the City Council. The amount of <br />said bond shall be determined by the City Engineer in <br />accordance with the provisions of the subdivision ordinance. <br />Adopted by the City Council this 5th day of.
