LAKE ELMO CITY COUNCIL MEETING, APRIL 15, 1980 <br />—3— <br />Legion Pond — The Council said that a feasibility study will be <br />necessary before any action to alleviate the problem can be taken. <br />The cost of such a study would have to be paid for by Legion Avenue <br />residents.- Mr. Collyard indicated this would be agreeable. Armstrong <br />said.the City sent several residents notice in 1976, to relocate their <br />septic systems�•beoause of the water problem. Mr. Collyard said <br />due to the tccgqtal saturation of the ground this would not solve their <br />current probl6,ms. Collyard's attorney would like on record whether <br />or not the City plans to solve this problem. Armstrong said any <br />improvement would be done on the basis of assessing property owners <br />in that area; and, presently the City has no short term solution. <br />Residents would have to request such an improvement. MrV Collyard <br />requested the City consider pumpin4 such as was done on Lake Jane. <br />Armstrong moved, seconded by Morgan, to authorize the Engineer to <br />survey the problem on Legion Pond, and see if there is a visible <br />solution; and, if not, prepare a cost estimate for an improvement <br />project. Motion carried 5-0. <br />B. Roger Meyer — Purchase of City Pro ert — The Meyers agreed to <br />grant an easement for an ft. walking path from Lake Elmo Avenue <br />to the City parking lot, provided the City remove the condition <br />to share in any profit over $65,000 within the next five years. <br />Mottaz moved, seconded by Pott, to sell the old "Down Halle site <br />to Meyer Merchantile, for $3,500 plus costs. The profit—sharing <br />condition will be deleted in lieu of an 8 ft. wide pedestrain <br />walkway from Lake Elmo Avenue to the City parking lot. The walkway <br />will be placed on the south edge of the property or otherwise located <br />by mutual agreement of the City and Meyers. Motion carried 5-0. <br />PLANNING COMMISSION REPORTS: <br />A. Amend Section <br />tL.. OV1�y - <br />The Council reviewed the Planning.Commission recommendation to approve <br />this amendment. Pott expressed concern that there are no controls <br />on buildings or use in areas over 20A. <br />The Council agreed to amend the Zoning Ordinance as recommended by <br />the Planning Commission with a building in Ag being limited to an <br />agricultural building and agricultural use. <br />B. Amend Section 301.090B - Grandfather in lA lots platted before <br />October 16, 1979 - <br />The Council agreed with the Planning Commission recommendation to <br />amend the Zoning Ordinance to include this provision. <br />C. Amend Section 301.130, Zoning Ordinance, Restricting Mobile <br />Homes for Non -Residential Use - <br />The Council agreed with the Planning Commission recommendation to <br />amend the Zoning Ordinance and include this provision. <br />The Council instructed the Administrator to draft Ordinance 7910 <br />amending the City Code as follows: <br />Section 301.1300, Limiting the Number of Accessory Buildings, <br />r Section 301.090B, Grandfathering in lA lots platted before October 16, 1979 <br />\_ Section 301.130 and Section 402.010, Restricting Mobile Homes for <br />Non -Residential Use. <br />D. <br />
