LAKE ELMO CITY COUNCIL MEETING, AUGUST 19, 1980 <br />d.0 <br />LARSON VARIANCE: The City Attorney presented the final agreement with <br />one change. Dr. Machmier requested.that his assistant be <br />authorized -to conduct the required yearly inspections. <br />Mottaz moved, seconded by Armstrong, to approve the agreement <br />with the revision requested by Dr..Machmier. Motion carried 4-0. <br />The Larsons and the City signed the,approved agreement. <br />FOXFIRE GATE: The City Attorney advised the Council, that closing,off <br />the gate at the. -end of Jamaca is a,policy decision. The <br />City.,has .an oblig4tion,to:maintai.n the gate, per the.Development <br />Agreement;, but, does not have 'a legal obligation to retain <br />the gate, providedemergency services are available to this <br />section of the City. The City is not legally bound by a, <br />time limit to provide services (ie. fire and police) to a <br />particular area. Residents in Foxfire do have access and can <br />recieve emergencv.services from that access. The gate.was <br />a stipulation by the City to the.developer.' The Administrator <br />gave background data concerning access proposed by the developer <br />and the concerns of area residents. <br />Mottaz expressed concern about the ,increase in time for emergency <br />vehicles to reach Foxfre, using the access off Demontreville Tr. <br />The Council discussed construction of a barri:cdde that could <br />not be easily destroyed, as has been done to the current gate, <br />Administrator Whittaker advised that blocking off Jamaca <br />permanently is_not,.good`City policy. Mottaz reitterated this-, <br />position that _Jane Road N—should not be .used -as a through E , <br />road: or,,a colle:ctor,z`yeti ah:-.alternatp.,&ype, of .x'gate" should: be-:_ <br />exploredi <br />,Mottaz moved -,,,,seconded by. Novak, to:instruct the Administrator <br />not to take any permanent measures to close off Jamaca Avenue <br />and seek the City Engi.neer's opinion about construction a <br />barricade that would prohibit through traffic, but permit <br />emergency access. The Engineer is authorized up to $100 to <br />research the problem. Motion carried 470. <br />Councilman Morgan arrived at 6:00. <br />RIED PARK:., The condemnation papers have been drawn up and are in the <br />process of being executed. <br />PAY PLAN:, The Council reviewed the salary increases recommended by the <br />Administrator. The Council discussed individual increases (merit <br />and cost of living), but did not agree with.'the step increase <br />guideline.recommended in the current Pay Plan. After a <br />lengthy discuss.i_oli the Council agreed •on an overall 10o salary <br />increase over the 1980 salaries. They also agreed to declare <br />December 24 a legal holiday. <br />The Council reviewed the Administrator's salary request. Mottaz <br />commended Administrator Whittaker on an outstanding job and <br />recommended his salary increase should be more than 100. <br />Armstrong moved, seconded by Morgan,, to grant the Administrator <br />a 12% base salary increase for 1981, $800 allowance to attend the <br />ICMA National Conference, and-$50/month expense allowance, Motion <br />
