LAKE ELMO CITY COUNCIL MEETING, AUGUST 1�, 1980 <br />-3- <br />DINNER BREAK , Bents Elmo Inn <br />ENGINEER'S REPORT: Engineer Bohrer was unable to attend, Administrator <br />Whittaker reported on the following items: <br />A.. MSA #1 - The Speed Limit Resolution has been prepared and <br />sent out. The Engineer strongly recommends all the Council <br />members contact the District Traffic Engineer and request <br />the reduced speed zone. <br />B. Legion Pond - The easements have been prepared and sent <br />to the affected property owners. Councilman Pott asked how <br />the City would handle the assessments for those residents <br />granting easements should they request reduced assessments <br />or a fee for easement rights. Don Durand and Earl Goerss are <br />large property owners involved with granting easements. He <br />proposed, in order to expedite the test wells, the Council set <br />a dollar amount and give the Administrator authority to handle <br />such a situation should a request be made. This would be for <br />well easements only. <br />The Council discussed the value of the assessment vs the <br />easement right, crop damage, miscellaneous property damage, etc., <br />to try and determine an equitable amount. Durand will be <br />asked for well and pipe easements; Goerss, only well. <br />Morgan moved, seconded by Armstrong, to trade well and pipeline <br />easements in lieu of assessment plus damages with Don Durand; <br />and, offer Earl Goer.ss $I50 plus damages for a.well easement. <br />Other residents who will have the pipeline cross their property <br />would be offered the same proposition as Mr. Durand. Motion <br />carried 4.-0-1. Novak abstaining. <br />C. Eagle Point Permit - The Administrator reviewed the DNR <br />permit 'stating the City can operate within the restrictions. <br />The Engineer calculated no more than 20 acre feet of water <br />can be stored in the two proposed ponding areas between <br />Eagle Point and Lake Elmo. Additional permission and,.permits <br />would be necessary should the City decide to pond in these <br />areas.. Pott recommended discontinuing further consideration <br />of such ponding. Morgan disagrees with the Engineer's cal- <br />culations. He feels wherever possible, throughout the Watershed, <br />water should be ponded. The Administrator will contact the <br />County and the DNR and get their reaction and requirements to <br />ponding between these two lakes. Novak agreed this should be <br />pursued. Mottaz requested no action be taken until all Council <br />members have an opportunity to look over the proposed ponding <br />areas. The Council agreed. <br />D. Landscaping, Maintenance Building - The reported that the <br />ultimate drainage plan and landscaping around the building will <br />require moving 4,000 yds. of dirt. (Landscaping around the <br />building and the rough cut of the driveway can be done by the <br />City Crew.) ,Morgan questioned that this amount -of dirt will <br />have to be moved due to the design of the building. Whittaker <br />stated the permanent driveway and drainage swale constitutes <br />this work. The estimated cost is $5,000 to $6,000. This <br />is indicated on the site plan. The Administrator felt the <br />Council should be aware that this work will need. to be done, and <br />consider budgeting for it. The Council will consider the matter <br />after the building is comnlei-p_ <br />
