LAKE ELMO CITY COUNCIL MEETING, OCTOBER 7, 1980 -5- <br />LITTLE SUNFISH: Don Smith, Attorney for Homeowners Association <br />stated that the City is being asked to make available the vehicle <br />(pipe) for a permanent solution, after which the Watershed can <br />determine how and when it should be used He generally agreed <br />with the Engineers conclusion, that a temporary safeguard should <br />be instituted this fall... Failure of the plant would create a <br />health hazard. <br />Mottaz said the City cannot initiate any project without the <br />necessary permits. The immediate problem has to be taken care <br />of jAlternate 1), then, the necessary steps can be taken to <br />find a permanent solution. <br />Mrs Leslie asked if the Main Stem Project had a pipe running from <br />Sunfish to Horseshoe. She said Al Fandry, Barr Engineering, <br />indicated to her that he would prefer the pipe go down Minnehaha. <br />Birger Olson, Cimarron Iiomeowner President, said the primary <br />concern of the residents is the health hazard should the plant <br />wash out. <br />Jim Palmquist, 3M, suggested testing the plant and aet information <br />on the stability of the ground under the tank and determine the <br />condition of the tank. <br />Armstrong moved, seconded by Mottaz, to continue the hearing <br />until October 21, 1980, at 8:30 p.m, The Engineer is instructed , <br />to continue to investigate the alternatives; contact the <br />Valley Branch Watershed District and the DNB to get their <br />reaction to the proposed alternatives; and,:id6terrftine-,if_ test wells <br />are necessary to decide whether diking is possible or if pumping <br />is necessary . <br />Mottaz moved, -seconded by..Ar4istrong, to amend the motion to include <br />sleeking temporary pumping permits, bogin the process <br />for Alternate 3, and seek permits for diking, if necessary. <br />Motion 6—ar-ied'5-0. <br />Discussion: Councilwoman Novak feels Cimarron should meet the <br />same requirements as other developers and find alternate ponding <br />areas on their property. The City should not pump water downstream <br />until the impact of such action is determined. <br />Mottaz said the issue is the City's responsibility to assure 1300 <br />people a safe place to live. This problem was not caused by <br />Cimarron., <br />Morgan said Valley Branch must provide storage up -stream as part <br />of resolving problems downstream. <br />Motion carried 5-9. <br />Mayor Armstrong closed the hearing at 9:44 p.m. <br />
