LAKE ELCO CITY COUNCIL MEETING <br />Imm <br />M/S/P Mazzara/Dunn To accept <br />Landscaping and proceed with the <br />(5 ayes) <br />8.OLD BUSINESS: <br />the bid submitted by Buberl <br />improvements in Tablyn Park. <br />A. Hammes Mining Permit: Fraser stated that violations <br />noted in the Building Inspector's letter to Bill Hammes were not <br />recent violations, that some of them went back at least three <br />years. She further stated that she received a letter from a <br />citizen to the area of the Hammed stating that in their AMC-00E0 <br />judgement, the Hammes' had taken advantage of the City by nottl-I-83 ce <br />complying with the City's ordinances. Fraser suggested that very MEc-TimCr <br />specific action be taken to get these violations remedied. <br />Dunn stated that the Council should not confuse the mining permit <br />with any other violation. He felt that if the mining permit was <br />denied for unrelated items, the City is subject to liability and <br />further stated that he felt it would be unethical. <br />Morgan concurred with Dunn, and added that if the City handled <br />each violation as a separate issue, they could be much more <br />effective. <br />Fraser stated that if the City acted one -by -one, there could be <br />enormous legal expenses for the City. <br />M/S/P Fraser/Mazzara To extend the Mining permit for one <br />month. (4 ayes 1 nay <Dunn>) <br />Fraser stated that if there is substantial movement in this month <br />to correct the violations, we could then consider extending the <br />permit again. To grant the permit now for an extended period of <br />time is unreasonable. <br />Mazzara asked the Hammes' if the violations could be resolved in <br />a month: (Dorothy Lyons stated that they had been working on <br />them). Mazzara stated that rather than granting the permit for <br />one month, perhaps the Council should delay the permit for one <br />month and see if an agreement can be reached between the Building <br />Inspector and the Hammes'. <br />Fraser stated she did not want to prevent the Hammes' their means <br />of livelihood, but does not want things to continue as in the <br />pastinasmuch as they do as they please. <br />Eder advised the Hammes' to meet with the City Administration and <br />form some written agreement and to follow thru with the agreement. <br />Morgan stated that he would go along with the motion, but would <br />prefer that the violations be handled one at a time. <br />
