LAKE ELMO CITY COUNCIL MEETING 10-18-83 Page 6 <br />Eder advised the Hammes' to meet with the City Administration and <br />form some written agreement and to follow thru with the agreement. <br />Morgan stated that he would go along with the motion, but would <br />prefer that the violations be handled one at a time. <br />Dunn asked what violations in the letter from Building Inspector <br />pertained to mining. <br />Whittaker stated the use of the County Road in regards to weight <br />limits is in violation of the mining ordinance. <br />Dunn asked how the City was affected by County weight limits, and <br />Whittaker responded that the City does not want overweight trucks <br />leaving or entering a City permitted operation and destroy a <br />County Road that we all have to pay for. It is our obligation to <br />make sure the mining operation is run according to our standards <br />and state laws. <br />Whittaker further stated that the City has every right to <br />regulate the premise on which a licensed activity is taking <br />place. Our City Attorney says we have every right to enforce the <br />City Code as it relates to the premise where we are issuing a <br />permit. That premise has all of these violations that are listed. <br />B. Resolution for Safe Water Around Landfill: - M/S/P <br />Morgan/Fraser To adopt Resolution 3- 7 requesting <br />Ramsey/Washington County to continue working towards and to take <br />action for a solution to the drinking water supply problem of the <br />Lake Elmo residents surrounding contaminated Ramsey/Washington <br />County Landfill #1 site as amended. (5 ayes) <br />C. Park Commission Report: <br />1. Demontreville Ballfield: - Klaers informed the City <br />Council that the Park Commission was not spending the funds that <br />are in the 1983 CIP for Demontreville ballpark, but would like to <br />use those funds next year for equipment. <br />Eder stated that the Park Commission should be aware of how much <br />money remains in their CIP. Klaers to advise Park Commission of <br />this amount. <br />2. 5-Year CIP: - Whittaker discussed his memo to the <br />Park Commission suggesting amending the 5-Year CIP, which was <br />amended before submitting the LAWCON application, to bring it down <br />so it could be financed with our present reserves and our annual <br />budget allotment. The Park Commission accepted the <br />recommendations with the thought of reviewing them again in 1984. <br />Basically, we eliminated some of the "high -buck" items for Pebble <br />Park that were in the LAWCON grant, such as construction of a <br />hockey rink, the north ballfield, warming house, and fencing the <br />ballfield. The other elimination, under the current 5-Year plan, <br />would be the park shelter in Pebble Park. That is not to say <br />C <br />
