(4 ayes) 6-A Request from Teal Pass Estates for a single building permit prior to the signing of the final plat M S P Dunn/Mazzara To issue a single building permit prior to the signing of the final plat for Teal Pass Estates. Klaers stated that the City's concern in issuing this early building permit was that it could set an undesirable precedent. However, in view of the unusual circumstances, this would not happen. Klaers further stated that this building permit will not be issued until a Performance Bond and Developer's Agreement has been submitted to the City. (4 ayes) 7. Public Hearing for Castle Design - Shoreland Permit and Variance M S P Fraser/Mazzara To schedule a Public Hearing for Shoreland Permit and Variance on November 15, 1983, 7:45 P.m. (4 ayes) 8. Tartan Meadow - Final Plat Approval - Developer's Agreement Discussion 7-0 f11-91'0A0U1X C1r THE •GJE.v,o,E/� M/S/P Mazzara/Dunn approve the final plat for Tartan Meadows subject to the City Engineer's additional three recommendations; (1) The drainage and utility easement for the pond should extend across Outlot A to a point 90 feet west of the northwest corner of the Park; (2) The City should receive a deed for 120' x 120' area for a temporary turnaround at the north end of Leeward Avenue. Deed will be released when remainder of street is platted; (3) Walkway easements should be dedicated along the north line of Lot 1, the south line of Lot 3 and the north line of Lot 4, all within Block 1, as access to the Park. The easement along the common lot line between Lots 3 and 4 should be a total of 20 feet in width. (4 ayes) The City Engineer recommended that the "Time for Performance; Completion by City on Default" on page 4 of Developer's Agreement, should state November 1, 1984. Bohrer further stated that in particular, the City's concern was the blacktopping; that if building is done on the street, and the City is responsible for the maintenance of the street (snowplowing, etc.), the City wants to maintain a finished road, not a gravel road.
