LAKE ELMO CITY COUNCIL MINUTES 2-21-84 PAGE 3 <br />( M/S/P Fraser/Eder - To advise the County that Lake Elmo is not in <br />favor of Proposal "A" or Proposal "B" and would prefer Proposal "C"; <br />which is: to not purchase any additional land - to have the necessary <br />entryway within the presently owned park land - to rethink County <br />Road 19 from the south so that it enters onto Keats and that it <br />remains a regular road until it gets to park land. (Motion carried <br />5-0) <br />Mr. Perkovich stated it is anticipated that the entrance road will be <br />under construction in 1985, and cannot promise that all the <br />recommendations contained in Proposal "C" will be included in the <br />plan, or that proposals "A" and "B" will be totally scraped. <br />According to Perkovich, the County will have 1.3 million dollars of <br />projects under construction in Lake Elmo in 1984. -Swimming facility <br />- equestrian camping facility - pavement of the roads - parking <br />facilities - large picnic shelter. Also, there is a soil conservation <br />program in existance. <br />b. Lee Johnson: Shoreland permit on Lot 6, Oace Acres (new <br />home) and variances for lot size and setback from water. <br />Mr. Johnson stated his reasons for asking for the shoreland variance <br />are: - to minimize the amount of soil that would need to be disturbed <br />- not having to cut and trim the trees - better view from the lake. <br />The DNR's report of 1/26/84, recommended denial of this application <br />because a hardship cannot be determined for this property due to the <br />following: - the existence of alternative locations for the <br />house/garage which meet the ordinance requirements; - granting of the <br />permit (variance) would confer a right to the property which is not <br />enjoyed by, nor allowed to, adjoining and similar properties in the <br />area; - the lack of physical limitations of the lot which preclude <br />meeting the terms of the official controls. <br />The City Engineer's report of 2/16/84, recommends denial of this <br />permit until such time as the applicant revises the site plan to meet <br />the building setback or demonstrates the hardship. In addition, the <br />septic system design should be revised to show 953 SF of drainfield <br />trench area. The site plan should also be revised to show basement <br />floor elevation and final grading contours. <br />Morgan stated he is familiar with this lot and the surrounding <br />neighborhood. If the proposed plan means utilizing the lot more <br />effectively, he has no problem. The elevation of the lot is not a <br />problem. There are houses much closer to the water than this, with <br />much lower elevations. <br />MIS/ Morgan/Mazzara - To grant a <br />Lee Johnson on Lot 6, Oace Acres. <br />Eder,Fraser, Mazzara>) <br />shoreland permit and variance for <br />(Motion denied 1-4 <Dunn, <br />Eder stated if this variance is granted just for the view, perhaps we <br />should reduce the setback to eighty feet. <br />Mr. Johnson said it was more than just the view. It is the slicing up <br />of the terrain that doesn't seem natural. He would like to keep this <br />area as natural as possible. <br />
