LAKE ELMO CITY COUNCIL MINUTES 2-21-84 PAGE 4 <br />Bohrer said it was difficult to determine this because the sketch <br />doesn't list the proposed floor elevations of the house and garage. <br />It doesn't show the proposed grading, or how the area around the house <br />is going to be shaped to fit it. <br />M/S/P Fraser/Mazzara - To recommend that the Shoreland Permit be <br />denied until such time as the applicant revises the site plan to meet <br />the building setback or demonstrates the hardship. In addition, the <br />septic system design should be revised to show 953 SP of drainfield <br />trench area. The site plan should also be revised to show basement <br />floor elevation and final grading contours. (Motion carried (4-1 <br /><Morgan>) <br />Fraser stated that even given this, she may not vote in favor of this <br />variance based on the recommendation of the DNR, and does not want to <br />raise false hopes. <br />M/S/P Morgan/Dunn - If the Johnson's can demonstrate hardship, or <br />presents a plan that shows the requirements as laid out by the <br />Engineer, the City Council would not deny the request based on the <br />lot size. (Motion carried 5-0) <br />C. Robert Mogren: Shoreland permit for deck addition at 8738 <br />Lake Jane Trail . <br />Mr. Mogren plans to add onto an existing deck and enclose it for <br />three -season use to his home. The existing house elevation is <br />approximately 934, well above the flood level. The new addition to <br />the deck will place the structure approximately 130 feet from the OHWM <br />where only 100 feet is required. Since no bedrooms are being added, a <br />septic system evaluation is not required. The proposed work meets all <br />of the requirements of the Shoreland Ordinance. <br />M/S/P Mazzara/Morgan - To approve the shoreland application for a <br />deck extension for Robert Mogren at 8738 Lake Jane Trail. (Motion <br />carried 5-0) <br />d. MSA Discussion <br />Bohrer presented the Feasibility Report on improvements of 45th <br />Street, Julep Avenue and 47th Street from Jane Road North to Keats <br />Avenue to the Council. Bohrer stated that right now it looks like the <br />amount of assessment to each lot (depending on how many lots are <br />assessed) is from $340 to $420, but recommends proposed assessments at <br />approximately the same rate as Keats Avenue, about $750 per lot, <br />because of the unknown nature of the legal and court costs at this <br />point. <br />Bohrer asked the council's opinion on how the Morris Addition should <br />be assessed. There are lots in this addition that do not abut the <br />road. <br />How does the council feel on the proposed assessment per lot? Should <br />we use the actual estimated amount of $340 to $420 or should we use <br />assume it is about the same as Keats Avenue and go into the hearing <br />with about $750 per lot? <br />
