LAKE ELMO CITY COUNCIL MINUTES 4-17-84 PAGE 3 <br />with the right-of-way, park donation, and drainage recommendations of <br />the City Engineer as outlined in his 4-4-84 report. (Motion carried <br />5-0) <br />( B. Shoreland Permit for recently approved Crombie lot split <br />at 8120 DeMontreville Trail. <br />Since no variances are required, and the DNR had no problems with the <br />application; the City Staff recommended approval of this application. <br />M/S/P Morgan/Dunn - To approve the Shoreland Permit for Brian Crombie <br />on the newly created lot at 8120 DeMontreville Trail North. (Motion <br />carried 5-0) <br />C. Shoreland Permit and structure and drainfield setback <br />variances for Hammon T. Becken at Lots 3 & 4, Eden <br />Park 2nd Addition. <br />Mr. Becken is proposing to construct a single family home on lots 3 <br />and 4, Eden Park 2nd Addition. This property is located along the <br />south shore of Downs Lake. Bruce Folz appeared on behalf of the <br />Beckens. He reviewed the past history of Eden Park 2nd Addition and <br />the varying water and setback levels. The variances that the Beckens <br />are requesting are: (a) a structure setback of 92 feet from the OHW <br />where 200 feet is required; (b) the drainfield elevation of 895 where <br />897 is required; (c) a drainfield setback of 50 feet from the OHW <br />where 75 feet from the high flood is required. <br />The Engineer commented that he did not have any problem with varying <br />the setback for the structure or the drainfield since there was no <br />land on the property which could meet these requirements. Regarding <br />lowering the drainfield elevation from 897 to 895, the Engineer said <br />that although he cannot see any adverse environmental impacts from <br />this elevation he felt that since higher land existed, the drainfield <br />should be placed on the highest possible piece of property which could <br />meet the 897 elevation. This would require the use of an effluent <br />pump which is more expensive to install and maintain, however, it is a <br />standard practice used throughout many areas of Lake Elmo. <br />M/S/P Morgan/Dunn - To approve the Shoreland Permit and structure <br />setback variances for Mr. Becken on lots 3 and 4 of Eden Park 2nd <br />Addition, contingent upon the applicant meeting the conditions <br />setforth in the City Engineer's report dated April 11, 1984 excluding <br />the drainfield elevation comment and contingent upon the house <br />elevation and minimum drainfield elevation be staked by an engineer or <br />surveyor in the field. (Motion carried 5-0) <br />If the Beckens proceed with their plans for a tennis court, they would <br />be required to apply for a Shoreland Permit. <br />D. Jane Road North: Presentation of plans and specifications; <br />plus request to order advertisement for bids. <br />City Engineer Bohrer presented the plans and specifications to the <br />City Council. After a brief discussion, and contingent upon <br />modifying the plans to eliminate one turn -around at the mailboxes, the <br />following action was taken. <br />
