LAKE ELMO CITY COUNCIL MINUTES 5--1.-84 PAGE 2 <br />C. Review of appraisals for right--of-way required for the <br />19811 MSA Project plus .request to offer said amount to <br />property owners. <br />The City Engineer began this discussion on the MSA Project by t( <br />distributing sections of the appraisals submitted by Winnfield, Inc.., <br />regarding the Myrtle Eder, John and Janet Berschens, and Gerhard and <br />Linda Schmidt property. The Engineer also put up the maps of the MSA <br />Project and right-of-way on the wall. Eder, expressed concern that the <br />highest and best use of the land was not considered when the <br />appraisals were developed. Eder, felt that cluster development of <br />seven units per forty acres could bring a much higher appraisal of the <br />].and than considering one unit per ten acres residential development. <br />Eder felt that it was possible that the assumption by the appraiser <br />was not appropriate. <br />The Engineer reviewed the residential development criteria that is <br />permitted in residential zones as outlined in the rural residential <br />zone in the City Code. Eder indicated that without noting if the <br />appraisals considered cluster developments, that the values for the <br />right-of-way could be substantially different. <br />The Engineer noted that the VBWD reviews the MSA improvements as <br />required by law. The City, like any other developer, must abide by <br />the 1% run off rule. <br />Dunn indicated that if the appraisals were increased because of <br />potential development, then accordingly, the taxes on the land may <br />also increase. <br />r \ <br />M/S/P Fraser/Mazzara - To refer the.appraisals back to Winnfield <br />Inc., in order for them to consider residential cluster development in <br />arriving at appraised prices; or for Winnfsield, Inc., to give further <br />explanations to the City Council. as to haw the existing appraisals <br />were determined. (Motion carried 3-0-1 <Eder>) <br />Eder mentioned that a special meeting may be needed for the project to <br />con Inue on its sch.>duled time frame. After a brief discussion, it <br />was determined that a special meeting would not be needed as deferring <br />app z:isal.e, until Ma,Y 15th Would not delay the project.
