LAKE ELMO CITY COUNCIL MINUTES 5--1.-84 PAGE 2 C. Review of appraisals for right--of-way required for the 19811 MSA Project plus .request to offer said amount to property owners. The City Engineer began this discussion on the MSA Project by t( distributing sections of the appraisals submitted by Winnfield, Inc.., regarding the Myrtle Eder, John and Janet Berschens, and Gerhard and Linda Schmidt property. The Engineer also put up the maps of the MSA Project and right-of-way on the wall. Eder, expressed concern that the highest and best use of the land was not considered when the appraisals were developed. Eder, felt that cluster development of seven units per forty acres could bring a much higher appraisal of the ].and than considering one unit per ten acres residential development. Eder felt that it was possible that the assumption by the appraiser was not appropriate. The Engineer reviewed the residential development criteria that is permitted in residential zones as outlined in the rural residential zone in the City Code. Eder indicated that without noting if the appraisals considered cluster developments, that the values for the right-of-way could be substantially different. The Engineer noted that the VBWD reviews the MSA improvements as required by law. The City, like any other developer, must abide by the 1% run off rule. Dunn indicated that if the appraisals were increased because of potential development, then accordingly, the taxes on the land may also increase. r \ M/S/P Fraser/Mazzara - To refer the.appraisals back to Winnfield Inc., in order for them to consider residential cluster development in arriving at appraised prices; or for Winnfsield, Inc., to give further explanations to the City Council. as to haw the existing appraisals were determined. (Motion carried 3-0-1 <Eder>) Eder mentioned that a special meeting may be needed for the project to con Inue on its sch.>duled time frame. After a brief discussion, it was determined that a special meeting would not be needed as deferring app z:isal.e, until Ma,Y 15th Would not delay the project.
