LAKE ELMO CITY COUNCIL MINUTES 1-8-85
PAGE 4
What Mr. Grabski essentially did was to make three nonconforming lots
out of one non -conforming lot; and also sold the only acceptable site
for a drainfield (Lots 610 and 611) that had been planned for Lots 612
thru 615 and Lots 5211 thru 527 where a house now exists and is to be
included in the 201 Program. What this means is that our 201 Program
will probably have to buy back Lots 610 and 611 to get enough land to
solve the septic system problem.
The County Recorder's office used to be aware that whenever they got a
property transfer to record, and it was less than the City's required
acreage, they would notify the City and we would tell them whether or
not they could accept it. Somehow that practice has been
discontinued.
Bohrer suggested that we get together with the Recorder's office and
find out how we can get back to working together. They are not
responsible for enforcing our ordinances, but generally they should be
aware of it so we are working together.
The City Attorney has recommended that the City file suit to have this
land sale recinded. The owner can then come back and go though the
simple lot subdivision process, which should have been done, to see if
any subdivision is appropriate.
M/S/P Mazzara/Morgan - To commence legal action to have this land
sale recinded. (Motion carried 5-0)
6. City Council Reports (None)
7. Annual Organizational Meeting
A. Election of Acting Mayor
M/S/P Armstrong/Christ - To appoint Council member Bruce Dunn as
Acting Mayor during the absence of Mayor Morgan. (Motion carried
4-0-1 <Dunn>)
B. Appointment of financial institutions as the City's
official depositories.
M/S/P Christ/Dunn - To appoint the State Bank of Lake Elmo,
Washington Federal, Oak Park Heights, American National of St. Paul,
Offerman and Company, Inc., and Juran & Moody Company, Inc., as the
City of Lake Elmo's official depositories. (Motion carried 4-0-1
<Mazzara - employee of State Bank of Lake Elmo>)
C. Designation of Legal Newspaper
M/S/P Dunn/Mazzara - To designate the Washington County Review as the
Lake Elmo official newspaper. (Motion carried 5-0)
