LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 2 The City Engineer stated that Lake Elmo Avenue has County right-of-way, and to place anything on County right-of-way requires permission from the County. The determination has to be made where the property line is as the County right-of-way is wider than just curb to curb - it takes in some of the sidewalk or boulevard area. Another concern is that the flower box should project out at least as far as the sign does to avoid bumping into the sign. There were no residents present to offer comments for or against this proposal and the public hearing was closed at 7:30 p.m. Morgan stated that the proposed sign .looked very nice and he has no problem with it provided the County would approve it. The Council suggested that Ms. Lee determine whether or not there is room on her own property for the sign, which would eliminate the need for a variance. Or, if the County grants permission to place this sign in the right-of-way to come back before the City Council for a variance. t.. 6. City Engineer's Report A. Resolution approving newly designated MSA routes and mileage. The Engineer stated that at the January 8, 1985 City Council meeting, he was instructed to proceed with the documentation necessary to add 36th Street and Layton Avenue between Laverne Avenue and Trunk Highway 5 to the Municipal State Aid Street System, and provided a draft resolution required by MnDOT to add these streets. M/S/P Morgan/Christ - to adopt Resolution 85-3 designating 36th Street from Laverne Avenue to Layton Avenue, and Layton Avenue from 36th Street to Highway 5 as a City of Lake Elmo MSA Route. (Motion carried 5-0) B. Final plat for Nelson Estates At its February 11, 1985 meeting, the Planning Commission recommended. w approval of the final plat of David Nelson Estate subject to the three provisions in the Engineer's review letter of February 7, 1985. The Engineer recommended that the final plat be approved in accordance with the Planning Commission's recommendation and conditioned upon the execution of the Developer's Agreement. The Developer's Agreement can now be drafted and provides for the submission of plans and specifications, time to complete improvements, and security deposit for developer's performance. M/S/P Mazzara/Christ - To adopt Resolution 85-4 approving the final plat for David Nelson Estates contingent upon the applicant meeting the conditions set forth by the City Engineer in his memo of February 7, 1985 as recommended by the Planning Commission on 2-11-85; and contingent upon approval of the plans and specifications for the required improvements, and contingent upon applicant entering into a Developer's Agreement with the City of Lake Elmo.
