LAKE ELMO CITY COUNCIL MINUTES 2-19-85 PAGE 2 <br />The City Engineer stated that Lake Elmo Avenue has County <br />right-of-way, and to place anything on County right-of-way requires <br />permission from the County. The determination has to be made where <br />the property line is as the County right-of-way is wider than just <br />curb to curb - it takes in some of the sidewalk or boulevard area. <br />Another concern is that the flower box should project out at least as <br />far as the sign does to avoid bumping into the sign. <br />There were no residents present to offer comments for or against this <br />proposal and the public hearing was closed at 7:30 p.m. <br />Morgan stated that the proposed sign .looked very nice and he has no <br />problem with it provided the County would approve it. <br />The Council suggested that Ms. Lee determine whether or not there is <br />room on her own property for the sign, which would eliminate the need <br />for a variance. Or, if the County grants permission to place this <br />sign in the right-of-way to come back before the City Council for a <br />variance. t.. <br />6. City Engineer's Report <br />A. Resolution approving newly designated MSA routes <br />and mileage. <br />The Engineer stated that at the January 8, 1985 City Council meeting, <br />he was instructed to proceed with the documentation necessary to add <br />36th Street and Layton Avenue between Laverne Avenue and Trunk Highway <br />5 to the Municipal State Aid Street System, and provided a draft <br />resolution required by MnDOT to add these streets. <br />M/S/P Morgan/Christ - to adopt Resolution 85-3 designating 36th <br />Street from Laverne Avenue to Layton Avenue, and Layton Avenue from <br />36th Street to Highway 5 as a City of Lake Elmo MSA Route. (Motion <br />carried 5-0) <br />B. Final plat for Nelson Estates <br />At its February 11, 1985 meeting, the Planning Commission recommended. <br />w approval of the final plat of David Nelson Estate subject to the three <br />provisions in the Engineer's review letter of February 7, 1985. <br />The Engineer recommended that the final plat be approved in accordance <br />with the Planning Commission's recommendation and conditioned upon the <br />execution of the Developer's Agreement. The Developer's Agreement can <br />now be drafted and provides for the submission of plans and <br />specifications, time to complete improvements, and security deposit <br />for developer's performance. <br />M/S/P Mazzara/Christ - To adopt Resolution 85-4 approving the final <br />plat for David Nelson Estates contingent upon the applicant meeting <br />the conditions set forth by the City Engineer in his memo of February <br />7, 1985 as recommended by the Planning Commission on 2-11-85; and <br />contingent upon approval of the plans and specifications for the <br />required improvements, and contingent upon applicant entering into a <br />Developer's Agreement with the City of Lake Elmo. (Motion carried <br />5-0) <br />
