LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 4, 1986 Page 3 <br />M/S/P Christ/Dunn - to accept Merle Olson's letter of resignation <br />from the Parks Commission and send him a letter of appreciation <br />for his service on the Commission. (Motion carried 5-0). <br />6. PLANNING AND LAND USE <br />A. Public Hearing: Road Frontage Variance Request - <br />Patricia Anderson <br />Mayor Morgan opened up the public hearing at 7:30 p.m. in the City <br />Council chambers. <br />This is a public hearing to consider the request of Patricia <br />Anderson for a variance to the required road frontage and a simple <br />lot subdivision. <br />City records show that only the variance was approved on Lot 41, <br />contingent upon a 50 foot road easement and an easement to Lot 42 <br />for the septic system proposed under the 201 Program. <br />Councilman Dunn asked Bill Eder what the status was on these <br />contigencies. Bill answered that it will be on the deed when it <br />gets straightened out at the court house. <br />Since last August, Bill Eder's father has passed away and Bill <br />purchased the house on Lot 42. Bill also has purchased the former <br />Schultz property. Lot 41 is now in the Eder estate and Pat <br />Anderson is the executor of the estate. <br />The total size of the portion of Lot 41 under consideration is <br />1.54 acres. Of that area, 0.61 acres would need to be put into an <br />easement for future roadway use. This would leave 0.94 acres in <br />the remainder of the site for residential development. <br />Nancy Prince - The Planning Commission had to decide in whether we <br />wanted to allow one more house on the private road. In the past <br />we would allow somebody to put a road back to a house, but we will <br />not allow them to subdivide a piece of property on a private road. <br />However, there are already houses using the private road which is <br />a difference from what we have one in the past. Because of houses <br />already using a private road, we didn't feel that one more house <br />on a private road would be that much more of a. problem. As long <br />as the road easments are on all the deeds so that everyone can use <br />the road, the City would have no advantage to owning that because <br />of the Moris house in the way. <br />The public hearing was closed at 7:53 p.m. <br />Councilwoman Armstrong asked City Engineer Bohrer if the new lot <br />would be buildable and he answered yes, but they would still have <br />to apply for a building permit and have perk tests and submit the <br />required data. <br />
