LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 4,, 1986 Page 4 <br />M/S/P Christ/Morgan - to adopt Resolution 86-18 approving a <br />simple lot subdivision for Lot 41 that which is on record in the <br />City office to Patricia Anderson. (Motion carried 5-0). <br />M/S/P Dunn/Morgan - to adopt Resolution 86-19 approving the road <br />frontage variance contingent on a survey showing the 50 foot road <br />easement and a "Hold Harmless" statement absolving the City of any <br />responsibility for the maintenance of the existing private road. <br />(Motion carried 5-0). <br />B. Zoning District Amendment - A.M. and Paul Palzer <br />The applicants propose to rezone 40 acres of land from <br />Agricultural to Rural Residential. <br />Palzer - We would like to parcel it off so we can get a few homes <br />on there. Most of it is pasture right now. Interested in a <br />cluster where you are allowed seven homes on a. forty. <br />Nancy Prince - The following are the reasons the Planning <br />Commissioners voted for the rezoning: In the land use planning <br />map and Comprehensive Plan this area is indicated for general <br />rural use and low density housing would be appropriate for that <br />use as well as the present agricultural zone. Also in this <br />Comprehensive Plan is a map of soils and this area does not <br />indicate high quality soils. The reasons the Commissioners voted <br />against the rezoning indicated that also in the Comprehensive Plan <br />there is a section that discusses the preservation of Ag land and <br />we should make an attempt to preserve Ag land in the City. The <br />last property owner did request the Ag zoning. The neighbors that <br />are around this property are farming their land. <br />Steve Korhel, 5540 Keats Avenue N. - The previous owner, Mr. <br />Slaussen, seriously contemplated putting the land into corn. <br />The City Council expressed that it was an odd shape parcel and <br />surrounded by people that were engaged in agriculture. Because of <br />the uncertainty of the use, the Council suggested that they could <br />not support this rezoning unless more information was brought in. <br />M/S/P Morgan/Dunn - to table the Palzer Rezoning Request- for two <br />weeks for further consideration. (Motion carried 5-0). <br />C. Land Use - Zoning Inquiry: <br />Business Use in an Agricultural Zone <br />Mr. Mike Mazza.ra brought up a concern regarding an alleged code <br />violation on the Thomas Armstrong farm. <br />Mike Mazzara - In 1985 the Armstrongs purchased and built a 12,320 <br />sq.ft. Butler building on their farm, which is permitted in an Ag <br />zone 6roviding that it is used for Ag purposes. My contention is <br />that this building and some of the surrounding area is not used <br />for Agricultural purposes. I feel they are running a retail <br />
