LAKE ELMO CITY COUNCIL MINUTES JANUARY 5, 1988 PAGE 7 <br />the staff that the nature of the business on the propety has been the <br />same since the early 1970's at least. <br />Knaak further stated that Section 301.050B.2. of the Lake Elmo City <br />Code authorizes the continuation of uses of land and property within <br />the City in existence at the time of the enactment of the code. To <br />date the staff has not been able to discover any evidence which would <br />indicate the discontinuance of the use during that time, which would <br />be sufficient to bring it within the jurisdiction of the code and <br />prohibit it, nor have we been able to determine the negative <br />proposition that we could not find evidence that Mr. Gould had not <br />been operating on his current basis. <br />Knaak concluded that the remedy for controlling any activities in or <br />about the Gould premises does not lie in the Zoning Code, but in the <br />nuisance sections of the City Code, in particular Sections 1506 and <br />1507. <br />The Building Official gave Mr. Gould a deadline of May 1, 1988 to <br />complete the sloping and seeding on his property. Also a copy of the <br />above nuisance code should be given to Mr. Gould. <br />M/S/P Graves/Moe - to instruct the Building Official to work with Joe <br />Gould to restore a 4:1 slope on his property at 5749 Lake Elmo Avenue <br />by May 1, 1988 and to have the Building Official report back to the <br />Council. (Motion carried 4-0). <br />E. Adoption of 1985 and 1987 MN State Building Codes (Amended 1-19-88) <br />See Page 11 <br />The City of Lake Elmo needs to adopt the 1985 and 1987 Minnesota State <br />Building Codes in order to be current with changes made since the City <br />adopted the 1982 Building Code. Related City ordinances also have to <br />be updated and amended to be consistent with the new building codes. <br />The Planning Commission held the public hearing on the proposed <br />ordinance amendments on 12-14-87. After considerable discussion, the <br />Planning Commission assessed the following motion: "that the City <br />Council should approve the adoption of the 1985 and 1987 State <br />Building codes on an interim basis, while the Planning Commission <br />looks into this, and that the bond should be a minimum of $1,000 with <br />a maximum fine of $10,000 and that all permit fees be doubled, and <br />that the Planning Commission will be studying the question of City <br />Code content and code enforcement in Lake Elmo and will be bringing a <br />recommendation back to the City Council. <br />Steve DeLapp asked about requ Jring future business in Lake Elmo to <br />have mandatory sprinkler systems and that rea identshave pot::ential ly <br />mandatory sprinker systems which State Building !.Inspector Norm <br />SJzblcomir: has been try;ifig- to promote. <br />Jim McNamara explained that this item in regard to a sprinkler system <br />in a residential building was extremely controversial in Kansas City <br />at their meeting in September. There is an increase in the expense of <br />putting up a house together which would be between $3000-$4000 unless <br />you are talking about putting one sprinkler head by the furnace area. <br />
