If it was defined from the center of <br />the County road to the center of the cul-de-sac, then it would be 830 <br />feet. If it was defined from the center of the County road to the <br />farthest edge of the cul-de-sac, then it is about 850 feet. The <br />preliminary plat shows that the distance of the cul-de-sac from the <br />edge of the County right-of-way to the center of the cul-de-sac is 800 <br />feet and the Council determined that no variance is required. <br />The applicant requested a variance from permanent ponding for volume <br />control., but they would still have the rate controlled ponding. VBWD <br />no longer enforces volume control. The City ordinances does not <br />differentiate between watersheds that have an improved outlet and <br />watersheds that do not. Councilwoman Armstrong stated the Council <br />made a concession for the trees with a 24' road width, but was not in <br />favor of making a concession to the trees on the ponding because it <br />was too important to Lake Elmo. <br />M/S/P Graves/Christ - to approve the Preliminary Plat for E.J. <br />Crombie, 2nd Addition; contingent upon compliance with the following: <br />1) adequate soil tests showing two drainfield sites on Lot 3; <br />2) ponds be designed with permanent storage, as outlined in the City <br />Engineer's memo of July 29, 1988, and temporary storage and outlfow <br />rates be established in accordance with VBWD requirements; <br />3) sediment and erosion control measures be taken in accordance with <br />VBWD requirements; <br />4) all Washington County Traffic Engineer's requirements be met; <br />5) unused wells and septic systems be abandoned in accordance with <br />applicable codes and Statutes; <br />6) adequate resolution of the County's request for an 80 foot <br />right-of=*way; <br />7) restrictive covenants, for development, address restrictions on <br />access from the County Road to outlots on Lake DeMontreville, <br />with no vehicular driveway access to outlots; <br />8) roadways within the development restrict parking on both sides <br />of the streets; and, further, that a variance be granted allowing <br />a 24 foot road width, (with no parking requirements on both sides <br />of roads) based on the uniqueness of the terrain and preservation <br />of existing trees; and, that a variance be granted waiving the <br />permanent pond requirement dedication and ponding easement on <br />Lot 2, Bloc], 1, F.J. Crombie, 2nd Addition, based on the <br />preservation of large trees in the area and sloping of land in <br />this area. <br />(Motion carried 2-1-1<Abstain: Johnson><Armstrong: expressed concern <br />of approving plat with so many contingencies; objected to variance for <br />ponding.
