With the <br />approval of this Permit, the clean-up process would be speeded up. <br />City's Position: <br />The length of time between water sampling and testing is not adequate <br />to detect any unanticipated large release of• pollutants. The opinion <br />of Councilmen Graves and Johnson and City Staff was that, at a <br />minimum, the frequency of testing of the discharge water be increased <br />to monthly, and that PCB's be included in the testing process. <br />Further, that some method of air stripping should be conducted on <br />Gradient Control #1 discharge, prior to entering the VBWD's system. <br />Additionally, other items to be considered include: <br />(1) Batching and testing be performed prior to release to VBWD system; <br />(2) Consideration be given to alternate of excavation of landfill; <br />(3) Further consideration be given to provision, by Wash. & Ramsey <br />Counties, to provide a neighborhood water supply system; and, <br />(4) Consideration be given to pursuing a formal hearing before the <br />full MPCA Board. <br />Councilmen Johnson and Graves suggested that the City pursue their <br />initial request for a formal hearing; before the full MPCA Board and <br />to continue denial of access across Jamaca until they are assured that <br />the water is clean. <br />The City Engineer informed the Council they could consider granting a <br />license for a certain time period which gives the City an opportunity <br />to review it. <br />The Council authorized the City Administrator and City Engineer <br />telephone Mary Luth, in a 3-way conversation, and reiterate that as a <br />result of the August 31st meeting, the City will not withdraw their <br />request for a formal hearing before the full MPCA Board and would deny <br />access across Jamaca until the frequency of testing of the discharge <br />water be increased to monthly, Batching and testing be performed prior <br />to release to VBWD system. Only then the City would consider a new <br />proposal from the County. <br />9. CITY ATTORNEY'S REPORT <br />City Attorney Knaak presented his Pending Litigation Report to the <br />City Council. <br />In regard to the 201 Condemnation File, the City Attorney will <br />continue discussion with the County Attorney and anticipates having a <br />firmer recommendation for the City by the next meeting. <br />
