A sample resolution was prepared. <br />Councilmen Williams and Bunt stated they were uncomfortable with the <br />arrangement of involving the City by their allowing the City Engineer <br />work for the developer and using someone elses money and suggested the <br />developer take over from here. <br />Rohrer responded this is somewhat unusual for Lake Elmo. In the past, <br />developer projects have always been planned and constructed by the <br />developer with the City providing the review of the plans and <br />specifications and making sure construction is being done under city <br />standards. This option is opened to all. developers, but this is the <br />first time it has been requested. A Developer's Agreement was approved <br />by the Council to protect the City's interest and the bills will be <br />paid. A. Letter of Credit is on deposit with the City. Bohrer has been <br />consulting with one of the owners, Don Raleigh and the agent, Bruce <br />Polz and has not deviated from city standards dictated in the <br />Agreement. <br />The Council asked the staff to check if the statements of cost the <br />City Engineer has submitted have been recovered. Copies of the <br />Developers Agreement will be sent to City Council. <br />M/S/P Hunt/Moe - resolved that Resolution No. 89-1, authorizing <br />advertisement for bids for Construction of 39th Street Roadway, <br />Drainage System and Watermain is hereby approved. (Motion carried <br />4-0). <br />B. Packard Park, 2nd Addition: Escrow Reduction #2 <br />City Engineer Bohrer reported the grading, gravel base, bituminous <br />surfacing, and pond grading have been completed on Packard Park 2nd <br />Addition. The only work items remaining are clean up and. boulevard <br />seeding and mulching. He estimated the $2,000 retainage would be <br />sufficient to ensure that this work is completed and recommend that <br />the letter of credit be reduced as follows: <br />Remaining Security $10,000 <br />Amount of this Release $ 8,000 <br />New Remaining Security $ 2,000 <br />Ann Bucheck, who has had water concerns with this development, asked <br />when the engineer inspected this work, was there water in the pond. <br />Bohrer responded his assistant, Tom Prew, did. not check into that, but <br />he will look into it. <br />M/S/P Moe/Hunt - resolved that the Council hereby approves reduction <br />of the Escrow for Packard Park 2nd Addition in the amount of $8,000. <br />(Motion carried 4-0). <br />
