LAKE, ELMO CITY COUNCIL MINUTES JANUARY 3, 1989 PAGE 8 <br />C. Resolution No. 89-2; MSA Designation for 15th St., <br />Annual Certification of Mileage <br />City Engineer Bohrer recommend 15th Street be designaed as an MSA <br />street based on his reasons listed in his letter to the Council dated <br />December 29, 1.988. A sample resolution was provided designating 15th <br />Street from Inwood Avenue (CSAH 13) to the west City limits as a <br />Municipal State Aid Street. <br />Councilman Williams suggested changing the Resolution from plural to <br />singular nouns since we are only designating one street, 15th Street. <br />M/S/P Williams/Hunt - resolved that Resolution No. 89-2, as amended by <br />Councilman Williams, Designating 15th Street as an MSA Road is hereby <br />approved, and further, that the Council further hereby approved the <br />MSA Annual Certification of Mileage. (Motion carried 4-0). <br />D. 5-Year Plan: State Aid Streets <br />All. Cities which are part of the Municipal State Aid System are <br />rquired to submit a proposed 5-year MSA Construction Program every 5 <br />years. The purpose of the program is to show that a City can utilize <br />all existing and anticipated MSA funds during the life of the program. <br />A City can be penalized if it accumulates more than $300,000 in its <br />construction fund account. <br />Rohrer recommended approval of the presented 5-Year Plan for MSA <br />expenditures over the next five years. The City is not bound by this <br />plan. It is a tool to be used by the City Council and City Engineer <br />in planning road. improvements. <br />M/S/P Williams/Moe - resolved that the Council hereby approves the <br />5-year State Aid Street Plan, as presented by the City Engineer on <br />January 3, 1989. (Motion carried 4-0). <br />9. CITY ATTORNEY'S REPORT: <br />Attorney Carlson submitted the pending litigation report which is <br />handled by their firm for. the City for the month of December and/or <br />can be anticipated to be active in January. <br />10. FIRE CHIEF'S REPORT: <br />Fire Chief Fran Pott explained the purpose of the Joint Powers <br />Agreement, which was to avoid the duplicity of services being offered <br />in the past to Springborn Green Acres. This Agreement has been <br />discussed with Mr. Springborn, and he is in full concurrence with this <br />action. The City Attorney, in conjunction with the Fire Chief has <br />prepared the Joint Powers Agreement,. in accordance with Council <br />direction. The Agreement has been 'approved and signed by Mahtomedi. <br />M/S/P Moe/Hunt - resolved that the Council hereby authorizes the Mayor <br />and Administrator to execute the Joint Powers Agreement, between the <br />Cities of Mahtomedi and Lake Elmo, for Medical Emergency services to <br />Springborn Green Acres. (Motion carried 4-0). <br />
