LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1.989 PAGE 3 <br />A. CONTINUATION OF REZONING APPLICATION (G. PELTIER) <br />Packard Park, 3rd Addition RR-R1 (from 2/7) <br />This rezoning application was postponed from 2/7 to this meeting. <br />M/S/P Graves/Moe - to bring back for consideration the rezoning <br />application by G. Peltier. (Motion carried 5-0). <br />Councilman Hunt advised the Council of Resolution 83-56 and minutes, <br />reflecting adoption by the Council on September 6, 1983, which amends <br />the Lake Elmo Comp Plan, with the agreement that this land would not <br />be rezoned for 1 1/2 acre use until after 1990. <br />Hunt added this particular rezoning was recommended to be turned down <br />by the PZ, and he would like to receive input from the PZ to see what <br />they feel as the planners, (planner, Mike Black, has recommended R-1 <br />zoning in this area) concerning where they see appropriate areas of <br />R-1 and RE. Once we find out the staff's inventory of Rl lots, and <br />before we have any rezonings of current land, Hunt felt we should <br />first of all find out if there is a shortage or oversupply of R-1 <br />lots. He would like to see the City act on RE Zoning and decide where <br />it fits into R1, the Comp Plan, and Future Land Use Map. <br />A public hearing on Residential Estates Zoning had been scheduled for <br />March 13th before the PZ, but Councilman Williams felt this was <br />premature and suggested postponement of the hearing until the PZ is <br />ready to provide their version to the Council and for them to receive <br />the Council's general reaction before a hearing is held. <br />Councilman Graves pointed out that the City should be aware of the <br />priority date of the application, what comp plan and future land use <br />map existed at the time. His understanding was, at the time of the <br />application, the 1986 comp plan was in effect, but it did not include <br />a Future Land Use Map; therefore, this application is consistent with <br />the existing 1986 comp plan and the Future Land Use Map included in <br />1979 Comp Plan. Graves added, this application was brought in prior to <br />an existence of an RE Zoning, and he believes they have to review this <br />application in consideration of the ordinances that existed at the <br />time. <br />Councilman Williams advised the Council that a Future Land Use Map, <br />dated 3-15-83, does show this area. as RR zoning. This map predates the <br />resolution and this map was considered, not only current zoning, but <br />Future Land Use. <br />Administrator Morrison stated, based on her research, it appeared this <br />map was incorporated in the 1979 Comp Plan which designates this <br />parcel to be Residential (Rl,R2 or R3). The 1.986 Plan that was sent <br />down to Met Council designated this area as RR, but it also contained <br />a future land use map dated Sept. 6 that designated all the area along <br />I-94 as Agricultural which she understands the City Council never <br />approved. <br />The Administrator pointed out that the applicant was probably not <br />
