LAKE ELMO CITY COUNCIL MINUTES F'EBRUARY 21, 1989 PAGE 7 <br />8. NPDES Agreement/License: Washington Co. Landfill #1 <br />Washington County asked for postponement of this Item. <br />9. CITY ENGINEER'S REPORT: <br />A. Request for Council Direction: Down's Lake and Eden Park Pond <br />At the February 7, 1.989 City Council meeting, Barr Engineering and the <br />VBWD presented their report on Down's Lake flooding. Time constraints <br />did not allow a full discussion of the alternatives. City Engineer <br />Bohrer distributed his 2/7/89 letter summarizing conclusions about the <br />report and suggested options. <br />Bohrer reported an outlet to Down's Lake is necessary for any solution <br />to the Eden Park area. An outlet on Down's Lake is necessary to <br />achieve the overall plan put forth in the 509 Plan and thereby <br />benefits more than the immediate watershed. (Refer to pages 14 and 19 <br />of the Barr report). According to the Barr report the approximate <br />construction cost. is $90,000 if the upstream easements and control <br />structures are not considered at this time, once an outlet from <br />Down's Lake is in place, an outlet from Eden Park can be considered. <br />This outlet would be to Lake Elmo or to Down's Lake as described in <br />his 2/7/89 letter. An outlet to Lake Elmo would povide a lower flood <br />level on the pond. <br />Councilman Williams provided a draft resolution for Council <br />discussion: <br />MIS/ Williams/Graves - Resolved that the City Council of Lake Elmo <br />expresses its dissatisfaction with the options presented by the Valley <br />Branch Watershed District in its Downs Lake Study, dated January 13, <br />1989, because the options do not provide relief from high water to the <br />residents around Eden Park Pond. Further, the City Council of Lake <br />Elmo requests the Valley Branch Watershed District Board of Managers <br />to study other options which will give relief from high water to the <br />residents around Eden Park Pond by providing some surface water outlet <br />from Eden Park Pond and Durand's Pond, including, but not limited to <br />the options proposed by Lake Elmo City Engineer Bohrer in his letter <br />to the City Council of February 7, 1989 <br />Further, Lake Elmo requests the VBWD to include a project to provide <br />an outlet from Downs Lake in its capital improvement program as a <br />Chapter. 509 Project. <br />Councilman Graves advised the Council that there are several bodies of <br />water not included in their study, but which we do not have <br />satisfactory answers such as, Legion Pond, 32nd St. Pond and the City <br />should ask the Valley Branch Watershed District how can they, quickly, <br />put together a comprehensive plan, and if money is not available, what <br />options exist to obtain it, other than bill the residents directly. <br />City Engineer Bohrer stated the reason he suggested to approach the <br />
