LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 26, 1989 PACE 4 <br />Larry Bohrer will notify the contractor that the road is not <br />acceptable and begin to investigate, according to the contract, <br />whether it is or isn't within the prescribed tolerances. Bohrer will <br />report back to the Council with more information. <br />B. 38th & 39th Streets <br />Mayor Dunn opened up the Public Hearing at 8:09 p.m. in the City <br />Council chambers. Notice of the public hearing was duly published and <br />sent. <br />City Engineer Bohrer reported the total cost for 38th Street and 39th <br />Street, West of Ideal Avenue Bituminous Overlay is $45,305.37. <br />Assessment Rate = $45,305.37 divided by 47 1/3 lots = $957.7.6/Lot. <br />Sodding has yet to be done around the culverts. <br />Gerald Wulfing, 8196 38th St. N., reported his intersection was <br />dangerous because of the rock on the road. Bohrer responded the <br />contractor will clean up gravel. <br />John Adams, 3948 Innsda.le Avenue N., asked if something would be done <br />on the mailbox side because there was a 3" drop on edge of the road. <br />Mr. Adams and Mr. Demco commented on the good paving job. <br />Mayor Dunn closed the Public Hearing at 8:23 p.m. <br />M/S/P Williams/Graves - to adopt Resolution No. 89-45 approving the <br />assessment roll and rate of $957.7.6/Lot for 38th Street and 39th <br />Street, West of Ideal Avenue, Bituminous Overlay Project. (Motion <br />carried 5-0). <br />C. 20th Street from Lake Elmo Avenue to Manning Trail <br />Mayor Dunn opened up the Public Hearing at 8:24 p.m. in the City <br />Council chambers. Public Hearing Notice was duly published and sent. <br />Larry Bohrer reported the total amount of the proposed assessment for <br />this project was $17,000, 19 parcels, at a. rate of $500/Lot. <br />Jean Durand, 11332 20th St., asked for a curb by Manning Trail because <br />of the rocks flying up and hitting the cars. Jean questioned her <br />assessment for 5 parcels when she was previously told 4 parcels and <br />asked why they were zoned Rural Residential when they are <br />Agricultural. Bohrer responded they have widened the radius and have <br />cleaned up the gravel by Kierkhafer, 2040 Manning Trail. Because the <br />road is narrow, Bohrer stated the cars kick up the rock onto the road <br />when they go off of the pavement. Bohrer indicated the previous <br />assessment roll. that he had shown the residents also had the Durand's <br />assessed for 5 parcels. Bohrer explained a possible reason they did <br />not have Ag Zoning was that Ag zoning had to be requested from the <br />City. <br />Mayor Dunn closed the Public Hearing at 8:38 p.m. <br />
