LAKE ELMO CITY COUNCIL MINUTES OCTOBER 17, 1989 PAGE 6 <br />M/S/P Hunt/Williams - to award the 1990 Recycling Contract to TMT <br />Recycling, Inc, and to instruct the staff to prepare a contract for this <br />service. This award is contingent upon execution of a Joint Powers <br />Agreement for Pine Springs and Grant Township for recycling services <br />provided by TMT Recycling, Inc. for 1990. (Motion carried 4-0). <br />C. Open Burning Proposed Ordinance <br />Fire Chief, Fran Pott and the City Administrator have been working with the <br />MPCA for several weeks in an attempt to incorporate verbage, allowing the <br />Fire Chief to issue burning permits, in an Ordinance which would satisfy <br />the MPCA. A proposed ordinance was presented to the Council for their <br />review. <br />M/S/P Williams/Moe - resolved that the Council hereby requests the <br />Administrator set a public hearing for the Ordinance amending Section 803 <br />of the 1979 Municipal Code, relative to Issuance of Burning Permits. <br />(Motion carried 4-0). <br />D. Building Permits <br />Administrator Morrison reported Frank Langer, Lake El.mo's Assessor, is now <br />in the process of assessing one⢠-quarter of the City's area. He has <br />informed the City there are a considerable number of home improvements <br />which have been undertaken since his last review four years ago without <br />the benefit of a permit. <br />including in the Newsletter <br />The Council. suggested A a frequent reminder defining the need for permits <br />with any construction.iRxkkaxNRK&tekknxx Mayor Dunn felt the lost revenue <br />could be handled, administratively, at the discretion of the Building <br />Official. Councilman Williams had a definite concern for possible safety <br />defects and was in agreement that the Building Official be more aggressive <br />in the future in finding out these things beforehand before project <br />completion. The Council's primary concern was that of safety; therefore, <br />they requested Mr. Langer make a list of the improvements made without <br />permits and distribute this list to the Council. Councilman Moe added <br />that once the word gets out that the City requires permits for any <br />building, this problem would be resolved. <br />E. Budget Extension for the 201 Project <br />Councilman Williams reported that he, the City Administrator, and. City <br />Engineer met with the MPCA staff to try to convince them to allow us a <br />budget extension to cover the Gorman condemnation and they refused. There <br />are two other steps: to appeal to the Director of Water Quality for the <br />MPCA and, if this fails, then appeal to the Federal EPA. Williams <br />recommended directing the Administrator to continue the appeal for budget <br />extension of the 201 Project. <br />M/S/P Williams/Moe - to direct the City Administrator to continue the <br />appeal for the Budget Extension for the 201 Project.
