RESOLUTION NO. R - 113 A RESOLUTION FOR THE CITY OF LAKE ELMO REGARDING EXCHANGE OF PROPERTY INTERESTS WHEREAS, Gilbert E. Sullwold and Viola Sullwold, husband and wife are property owners within the City of Lake Elmo; and WHEREAS, the above named Mr. and Mrs. Sullwold conveyed to the City of Lake Elmo an easement over a certain parcel of their property in conjunc- tion with Municipal State Aid street improvements in 1983 and 1988; and WHEREAS, Mr. and Mrs. Sullwold have had their property surveyed for the purposes of land registration proceedings; and - - WHEREAS, the City of Lake Elmo is no longer is need of said easement; and WHEREAS,'Mr._ and Mrs. Sullwold are prepared to grant fee title to the City of Lake Elmo in a certain portion of their land and a permanent road easement over another portion of their land in exchange for the City of Elmo's release of their previously granted easement; and WHEREAS, Raymond O. Marshall, Esq.-attorney for Mr. and Mrs. Sullwold has agreed to prepare the three deeds necessary to complete this transaction, NOW, THEREFORE, BE IT RESOLVED that the City of Lake Elmo shall upon presentation of the required deeds, convey to Gilbert E.'Sullwold and Viola _ -- Sullwold, husband and wife the following parcel: The south 140.00 feet of the east 10.00 feet of the west 43.00 feet of the North Half of the Northwest Quarter of the Northwest Quarter of Section 11, Township 29 North, Range 21 West, City of Lake Elmo, -Washington County, Minnesota; and-.. - FURTHER LET IT BE RESOLVED, that the City of Lake Elmo shall accept in fee simple from Gilbert E. Sullwold and Viola Sullwold, husband and wife the following parcel: The west 33.00 feet of the North Half of the Northwest Quarter of the Northwest Quarter of Section 11, Township 29 North, Range 21 West, City of Lake Elmo, Washington County, Minnesota which lies south of the north 192.98 feet thereof; and
