RESOLUTION NO. R-16 <br />A RESOLUTION FOR THE CITY OF LAKE ELMO <br />OF COMPLETE SUPPORT FOR LEGISLATION <br />REPEALING THE AUTHORITY OF THE MINNESOTA MUNICIPAL BOARD <br />TO DETACH FROM A MUNICIPALITY ANY LAND BASED UPON A PETITION <br />OF AFFECTED LANDOWNERS <br />WHEREAS, the City of Lake Elmo is located in Washington <br />County, Minnesota; and <br />WHEREAS, the City of Lake Elmo is bordered on two sides <br />by heavily used metropolitan freeways; and <br />WHEREAS, the City of Lake Elmo has developed over the <br />course of many years a carefully considered Comprehensive Plan and <br />Zoning Code for the purpose of preserving the predominantly rural <br />character of the City of Lake Elmo while permitting steady and <br />controlled commercial growth along freeway corridors, as well as <br />within the other commercial areas of the City; and <br />WHEREAS, the City of Lake Elmo has not been as enthusiastic <br />a promoter of taxpayer's subsidies for development as has its <br />neighboring municipalities; <br />WHEREAS, as a result of this more conservative approach <br />and concern for the integrity of its Comprehensive Plan, developers <br />and landowners adjacent to neighboring cities have, in an effort to <br />seek those public subsidies and avoid the provisions of Lake Elmo's <br />zoning regulations, petitioned or threatened to petition the <br />Municipal Board of Minnesota in an effort to detach themselves from <br />the City of Lake Elmo; and . <br />WHEREAS, it is the belief of the City Council and citizens <br />of Lake Elmo that this effort goes well beyond the originally intended <br />purpose of Chapter 414, which grants authority to the Minnesota <br />Municipal Board; and <br />WHEREAS, if all pending and threatened detachments by <br />landowners were to occur, the City of Lake Elmo could, within a <br />year, lose up to 14% of its current land area; and <br />WHEREAS, the City of Lake Elmo believes that this <br />authority on the part of the Municipal Board to accept petitions <br />from landowners is now being seized upon by developers as an effort <br />to disrupt the very integrity of municipalities and their authority <br />to enact reasonable zoning regulations and comprehensive plans; and <br />
