RESOLUTION NO. 89-20 <br />A RESOLUTION FOR THE CITY OF LAKE. ELMO <br />REGARDING THE PROPOSED DETACHMENT OF SECTION 32 <br />AND W 1/2 OF SECTION 33 FROM THE CITY OF <br />LAKE. ELMO AND ANNEXED TO THE CITY OF OAKDALE <br />WHEREAS, the City of Lake Elmo, Washington County, is a statutory <br />city, existing and authorized pursuant to the laws of the State of <br />Minnesota; and <br />WHEREAS, certain individuals owning land in Section 32, and the W <br />1/2 of Section 33, Township 29 North, Range 21 West all. within the <br />City of Lake Elmo have submitted a petition for detachment of their <br />property from the.City of Lake Elmo and annexation to the City of <br />Oakdale to the Municipal Board for the State of Minnesota pursuant to <br />Minn. Stat. 414.061, subd. 5 identified by the Municipal Board as <br />D-248 Lake Elmo/A-4573 Oakdale, Sec. 32 and W 1/2 of Sec. 33; 523 <br />acres; and, <br />WHEREAS, those lands being sought for detachment are a vital <br />portion of the future planning and potential development for the <br />contiguous area known as the City of Lake Elmo; and <br />WHEREAS, detachment of said land would result in a loss of <br />current and future tax revenue for the City of Lake Elmo; and <br />WHEREAS, it is unlikely that proposed detachment and annexation <br />would result in any increased benefit to the planning and land use <br />patterns currently in effect for the area; and <br />WHEREAS, the proposed concurrent detachment and annexation <br />proceedings may result in the detachment of said lands and further <br />establish this procedure as a method of resolving differences in <br />development philosophies between the City of Lake Elmo and individual <br />landowners within the city; and <br />WHEREAS, there has been no formal communication between the <br />cities of Lake Elmo and Oakdale regarding the issue raised by proposed <br />annexation and detachment; and <br />WHEREAS, there is currently pending before the Municipal Board <br />the matter identified as D-239 Lake Elmo/A-4453 Oakdale regarding the <br />detachment of part of the same Section 32 from the City of Lake Elmo <br />and annexation to the City of Oakdale which has not been finalized; <br />and <br />WHEREAS, until there has been a final determination of the <br />previous detachment and annexation petition, all. the necessary factors <br />cannot be fully considered by this Council, - <br />WHEREAS, the City of Lake Elmo is actively exploring means to <br />encourage responsible development of the affected area, <br />
