LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1990 PAGE 7 <br />M/S/P Graves/Williams - to direct the City Engineer to review these <br />MPCA rules relating to water quality being revised by the MPCA to <br />determine if there is opportunity to modify the language or any of the <br />definitions to include that existing or proposed landfills can be <br />covered, by these new regulations. (Motion carried 5-0). <br />F. Update of the Appeal to the EPA <br />On January 11, 1990 Mr. Sherkenbach notified the Mayor that he had <br />reviewed the file and saw no reason to change his denial. He also <br />told the Mayor that the city could talk to the commissioner again or <br />to the citizens board. Mr. Sherkenbach told Larry Bohrer that he <br />didn't know what affect that might have because what we are dealing <br />with is federal regulations that have been delegated to the state to <br />enforce, and he didn't know how much input the state citizens board <br />would have on these federal regulations. He would like to talk about <br />all the issues at once; such as, whether the cost for the land and the <br />legal fees and engineering fees that were necessary because of the <br />land value appeal, would they be considered eligible for the grant. <br />Bohrer added, Mr. Sherkenbach offered to rescind his December 7th <br />denial so we can include all issues at one time. After conferring <br />with the Mayor, Bohrer told Mr. Sherkenbach that the City would accept <br />his offer to rescind the denial as long as the next step is a <br />(face-to-face) meeting so we can define what they consider issues. <br />Bohrer should receive a letter this week from Mr. Sherkenbach <br />rescinding his December 7th denial. No date has been set for this <br />meeting. <br />8. PLANNING/LAND USE/AND ZONING: <br />A. Conditional Use Permits Review <br />Building Official, Jim McNamara, provided the Council a Conditional <br />Use Permit Review. (See letter from Jim McNamara to Council dated <br />January 11, 1990.) <br />Councilman Williams asked Dr. Swanson, if when the crematorium is <br />relocated to the new building, he anticipates increasing its size or <br />capacity in any way. Dr. Swanson responded he would be increasing the <br />capacity, although it is not absolute because of projection for volume <br />needs. The proposal would be to improve on the building when it was <br />built, such as, physical construction and chimney stack emission <br />control under any new MPCA requirements. Swanson acknowledged this <br />proposal would come back before the Council. <br />In regard to the boarding space for the Animal Inn, Don Tauer stated <br />now he is limited to 117 dogs in the kennel at any time. He <br />understood he would have to come back to the Council to request <br />expansion to 200 animals. <br />Jim McNamara indicated that Charles Anderson of the Animal Inn <br />Training School is considering to add on to his building because he <br />needs more room for the number of dogs per class. <br />
