The creek bisects Lot 10, Beau Haven Addition and Mr. Buelow is the owner <br />of the lot. This work is also governed by the City's shoreland Regulations because the shoreland <br />district in this area is 300 feet either side of the creek. The VB WD has reviewed the hydraulic <br />characteristics of the bridge and has issued their permit for the work (see attachment). <br />This application brings up the larger issue as to the intended use of the lot. It is the City staff's <br />recollection that this lot was declared unbuildable several years ago because a large portion of the <br />lot is flood plain. <br />The lot is slightly over 0.5 acres in size and does not meet the 60% Rule for existing platted lots <br />of record, In addition, not all of the land is usable because of the flood plain. <br />Recommendation <br />It would be best to find out the owner's intention for the lot first before passing on this permit <br />application. We have no objection to the bridge itself because the Watershed District has <br />checked that the 100-year flow can pass beneath it. We are concerned that the owner may feel a <br />large expenditure for this bridge somehow may obligate the City to future approvals on this lot. <br />Sincerely yours, <br />/ , 4 <br />Larry D.
