LAKE ELMO CITY COUNCIL MINUTES MAY 1, 1990 PAGE 9 <br />Scott Nietzel, 3291 Lampert Avenue N., stated the street was in <br />terrible condition and had no problem with the project. Hei asked if <br />the overlay would match up to his concrete driveway. Bohrer responded <br />the overlay would match right in with his concrete driveway. <br />Mayor Dunn closed the public hearing at 9:42 p.m. <br />M/S/P Graves/Hunt - to approve Resolution No. 90-20, Proceed with the <br />bituminous overlay street improvement project for Lampert Avenue from <br />32nd Street to Lower 33rd Street. (Motion carried 5-0). <br />7. CITY ATTORNEY'S REPORT: <br />A. Easement on 30th Street <br />Attorney Carlson explained the City has been given notice of a hearing <br />scheduled for May 3rd at Washington County District Court to determine <br />who is the underlying fee owner of land which lies between the Taylor <br />and the Mazzara parcels and explained what options the City had in <br />this matter. <br />M/S/P Williams/Graves - to instruct the City Administrator to write a <br />letter to the Washington County Court stating that based on finding <br />that the easement does not now serve a useful public purpose, the City <br />intends to grant a quit claim deed to whomever is found by the court <br />to be the correct fee owner. (Motion carried 5-0). <br />B. Litigation Report <br />The Council received the monthly pending litigation report. <br />B. CITY COUNCIL REPORTS: <br />A. Section 32 Update <br />Councilman Hunt pointed out the articles in the newspaper stating <br />there has been a settlement in Section 32 were incorrect and heavily <br />based on rumors. A draft has been prepared by the negotiating teams <br />with the input of property owners and is currently in the hands of the <br />Lake Elmo's and Oakdale's attornies for their review. When this <br />document is finished, it will be presented to both Councils and to the <br />public, simultaneously, for public discussion. The details have been <br />discussed as reflected in the City Council minutes of April 23, 1990. <br />B. Personnel Committee <br />Councilman Williams pointed out the Personnel Committee was to meet to <br />discuss the City Administrator's contract and asked this be <br />accomplished. Councilman Graves indicated he has been out-of-town <br />longer than expected and has not had an opportunity to get together <br />with the Committee, but intends to accomplish this as quickly as <br />possible. Mayor Dunn has consented, if needed, to sit in any <br />committee if Councilmen Hunt or Graves cannot attend the meeting. The <br />City Administrator will call this meeting. <br />
